CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AUTHORIZING ACCESS TO SUMMARY
CRIMINAL HISTORY INFORMATION FOR EMPLOYMENT,
LICENSING. OR CERTIFICATION PURPOSES.
WHEREAS, Penal Code Sections ll105(b) (10) and 13300(b) (10)
authorize a city to access state and local summary criminal history
information for employment, licensing, or certification purposes;
and
WHEREAS, Penal Code Section ll105(b) (10) and 13300(b) (10)
require that there be a requirement or exclusion from employment,
licensing, or certification based on specific criminal conduct on
the part of the subject of the record; and
WHEREAS, Penal Code Sections ll105(b(10) and 13300(b) (10)
require the City Council of a City to specifically authorize access
to summary criminal history information for employment, licensing,
or certification purposes.
NOW, THEREFORE, BE IT RESOLVED by the city Council of the
City of South San Francisco that the City is hereby authorized to
access summary criminal history information for employment,
licensing, or certification purposes; and
BE IT FURTHER RESOLVED by the City Council of the City of
South San Francisco that it shall not consider a person who has
been convicted of a felony or misdemeanor involving moral turpitude
eligible for employment or licensing, except that such convictions
may be disregarded if it is determined that mitigating
circumstances exist, or that the conviction is not related to the
employment or license in question.
I hereby certify that the foregoing Resolution was regularly
introduced and adopted by the City Council of the City of South San
Francisco at a reqular meeting held on the 13th day of
December, 1995, by the following vote:
AYES:
Councilmembers Joseph A. Fernekes. Euqene R. Mullin.
John R. Penna. Robert Yee and Mayor Jack Drago
