HomeMy WebLinkAboutReso 27-1996-- RESOLUTION NO. 27-96 RESOLUTION OF THE CITY OF SOUTH SAN FRANCISCO CITY COUNCIL ADOPTING A MITIGATED NEGATIVE DECLARATION AND APPROVING AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN OF THE CITY OF SOUTH SAN FRANCISCO TO ALLOW FAST FOOD DRIVE-THRU RESTAURANTS TO LOCATE ON EL CAMINO REAL NORTHERLY OF WESTBOROUGH BOULEVARD IN COMMERCIAL CENTERS. WHEREAS, an application has been received for an amendment to the Land Use Element of the General Plan of the City of South San Francisco to allow fast food drive-thru restaurants on E1 Camino Real northerly of Westborough Boulevard in commercial centers; and WHEREAS, an environmental initial study (the "Initial Study") which considered the potential environmental impacts of the General Plan Amendment was processed and reviewed in accordance with the California Environmental Quality Act. The Initial Study determined that the General Plan Amendment may have potentially significant impacts on the environment which could be mitigated to a level of insignificance; and WHEREAS, based upon the Initial Study and other information including, but not limited to, the E1 Camino Real Corridor Plan Environmental Impact Report, and a Traffic Study prepared by the Wilson Engineering Company, a Mitigated Negative Declaration was prepared for the Project pursuant to Pub. Res. Code Section 21080(c)(2) and was made available for public review pursuant to Pub. Res. Code Sections 21091 et seq.; and WHEREAS, on February 15, 1996, the Planning Commission of the City of South San Francisco (the "Planning Commission") held a duly noticed public heating on the proposed Mitigated Negative Declaration and the General Plan Amendment; and WHEREAS, after having reviewed and considered all evidence and testimony in the record, the Planning Commission voted to recommend to the City Council of the City of South San Francisco (the "City Council") adoption of a Mitigated Negative Declaration for the General Plan Amendment and approval of an amendment to the Land Use Element of the South San Francisco General Plan. WHEREAS, after having conducted a duly noticed public hearing on February 15, 1996 and after having reviewed and considered all evidence and testimony in the record, the Planning Commission voted to recommend to the City Council of the City of South San Francisco (the "City Council") adoption of a General Plan Amendment; and WHEREAS, such an amendment will provide for increased opportunity for development in commercially designated areas along E1 Camino Real between Westborough and Hickey BouleVards where it can be demonstrated that either no adverse traffic, noise, odor or aesthetic impacts will occur, or, because measures are incorporated into the design of proposed development and/or mitigation measures are adopted which will reduce the impacts to a level of insignificance. NOW, THEREFORE, BE IT RESOLVED that the City Council adopts a Mitigated Negative DeclaratiOn for the General Plan Amendment based on the following findings: 1. The City Council certified the E1 Camino Real Corridor Plan EIR and Redevelopment Plan in June 1993 and July 1993, respectively. The E1 Camino Real Corridor Plan EIR contains a comprehensive review of potential impacts on the environment from development in the area along E1 Camino Real between Westborough and Hickey Boulevards. The E1 Camino Real Plan EIR incorporates the projected commercial build out including the Project, and analyzes the potential environmental impacts of such build out. The E1 Camino Real Corridor Plan include the adoption of measures designed to mitigate any environmental impacts of development pursuant to the E1 Camino Real Corridor Plan, including those that may result from the General Plan Amendment. 2. In addition, an Initial Study of the Mitigated Negative Declaration was prepared to consider whether the General Plan Amendment could have any potentially significant impacts on the environment that were not previously analyzed in the E1 Camino Real Corridor Plan EIR. The Initial Study of the Mitigated Negative Declaration determined that the General Plan Amendment may result in proposed developments which may have traffic, circulation, noise and odor impacts. However, these impacts are more appropriately addressed at the time of review of future individual proposed developments and the impacts can be reduced to a minor level through requiring changes in the future proposed developments and the adoption and implementation of mitigation measures. 3. Based upon the E1 Camino Real Corridor Plan EIR, the Initial Study of the Mitigated Negative Declaration and the entire record before the City Council, the City Council finds that the General Plan Amendment will not have any impacts that are individually limited, but cumulatively considerable. 4. Based upon the E1 Camino Real Corridor Plan EIR, the Initial Study of the Mitigated Negative Declaration and the entire record before the City Council, the City Council finds that the General Plan Amendment does not have the potential to result in any significant impact on the environment. 5. The Initial Study and the Mitigated Negative Declaration reflect the City Council's independent judgment. BE IT FURTHER RESOLVED that the City Council adopts, as set forth in Attachment "A" hereto, an Amendment to the Land Use Element of the General Plan to allow fast food drive-thru restaurants on E1 Camino Real northerly of Westborough Boulevard in commercial centers. BE IT FURTHER RESOLVED that the amendment to the Land Use Element approved herein shall become effective thirty (30) days after its passage and adoption. Penna, Robert Yee and Mayor Jack Draqo None' NOES: ABSTAIN: None ABSENT: None GP-4 ATTEST: ~ CLERK~~ RESOLUTION NO. 27-96 ATTACHMENT A LAND USE ELEMENT AMENDMENT The language related to fast food restaurants is amended to read as follows: Most of the major chain fast food restaurants in South San Francisco are located on El Camino Real between Arroyo Drive and Hazelwood Drive. Because these uses may create problems related to traffic, loitering, odors and litter, such uses should be limited to certain areas of the City. Fast food restaurants have generally been accepted as an apppropriate use in the south El Camino Real area and the SouthAirport Boulevard area because of the character of the surrounding retail uses, good vehicular access and the detachment of these areas from residential neighboroods. Fast food restaurants along El Camino Real north of Westboroough Boulevard may be allowed subject to the use being integrated within a commercial center and being an accessory use to the principle use of the site. New fast food restaurants would not be acceptable in other areas of the community, as their presence may create conflicts with the established residential neighborhoods and more restricted uses. Policy 29 Fast food restaurants may be allowed Along El Camino Real soouth of Westborough Boulevard. Fast food Restaurants may also be allowed along E1 Camino Real north of Westborough Boulevard provided the use is accessory to the principle building or, use in the commercial center, and the fast food service provides, adequate parking and circulation facilities, and the site plan, building design, signage and landscaping are compatible with the surrounding area.
