CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION APPROVING A CONTRACT
AMENDMENT WITH WAGSTAFF & ASSOCIATES
FOR THE TERRABAY SUPPLEMENTAL EIR
WHEREAS, in June, 1995 the City Council authorized a contract with
Wagstaff & Associates for preparation of the Terrabay supplemental Environmental
Impact Report; and
WHEREAS, due to the unusual level of public comment on the draft
environmental document, City staff has determined that a revised scope of work is
necessary for preparation of the final supplemental EIR; and
WHEREAS, the costs for preparing the final supplemental impact report shall
be paid to the City by the developer prior to execution of the contract amendment;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
South San Francisco as follows:
1. The City Manager is hereby authorized to execute Amendment No. 1 to
the June, 1995 agreement between Wagstaff & Associates and the City of South San
Francisco. A copy of the contract is attached hereto.
I hereby certify that the foregoing Resolution was regularly introduced and
adopted by the City Council of the City of South San Francisco at a regul ar
meeting held on the 22nd day of May , 1996 by the following
vote:

EXHIBIT TO RESOLUTION NO. 92-95
AMENDMENT NO. 1 TO CONSULTANT SERVICES AGREEMENT
BETWEEN THE CITY OF SOUTH SAN FRANCISCO
AND WAGSTAFF & ASSOCIATES
RELATED TO THE TERRABAY SUPPLEMENTAL EIR
RECITALS
WHEREAS, in June, 1995, the City Council of the City of South San
Francisco authorized a' contract with Wagstaff & Associates for preparation of a
supplemental EIR for the Terrabay project; and
WHEREAS, the draft supplemental EIR was prepared and released for public
review on January 5, 1996; and
WHEREAS, due to the unusual level of public comment on the draft
environmental document, City staff determined that a revision was necessary in the
scope of work for preparation of the final supplemental EIR; and
WHEREAS, the revised scope of services presented by Wagstaff & Associates
contains Option No. 1, no recirculation-of the draft SEIR, and Option No. 2,
recirculation of the revised draft SEIR and preparation of a final SEIR; and
WHEREAS, both parties agree that unless the City authorizes proceeding
under Option No. 2, recirculation of the draft SEIR, Wagstaff & Associates shall only
be entitled to an additional, not-to-exceed amount of $38,782, based on the labor
activities set forth in the attached Exhibit A; and
WHEREAS, in the event that the City determines that Option No. 2,
involving recirculation of the draft SEIR is desired, Wagstaff & Associates will be
entitled to an additional amount not exceeding $45,632 for the activities set forth in
Exhibit A; and
WHEREAs, the additional expense necessary for preparation of the final
supplemental EIR for the Terrabay project will be funded by the developer of the
project.
NOW, THEREFORE, the City of South San Francisco and Wagstaff &
Associates do hereby agree as follows:
1. The contract entered into in June, 1995 related to the Terrabay project
is hereby amended by adding the scope of services and cost breakdowns set forth in
Contract Exhibit A attached hereto. The schedules for preparation of documents set
forth in the original June, 1995 contract is hereby amended to reflect the schedule set
forth in subsection C of Exhibit A attached hereto.
2. All other terms and conditions in the contract entered into between the
City and Wagstaff & Associates dated June, 1995 shall remain in full force and effect.
