RESOLUTION OF THE CITY OF SOUTH SAN FRANCISCO CITY COUNCIL
APPROVING ADOPTION OF THE NEGATIVE DECLARATION RELATED TO THE
APPROVAL OF: (1) AN AMENDMF~T TO THE ZONING ORDINANCE OF THE CITY OF
SOUTH SAN FRANCISCO ADDING CHAPTER 20.39, THE "RESEARCH AND
DEVELOPMENT OVERLAY DISTRICT REGULATIONS," (2) AN AMENDMENT OF THE
ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO ADDING
CHAPTER 20.40, THE "GENENTECH RESEARCH AND DEVELOPMENT OVERLAY
DISTRICT REGULATIONS" AND (3) AN AMENDMENT TO THE ZONING MAP OF THE
CITY OF SOUTH SAN FRANCISCO RECLASSIFYING CERTAIN GENENTECH
PROPERTIES FROM PLANNED INDUSTRIAL (P-l) TO PLANNED
INDUSTRIAL/GENENTECH RESEARCH AND DEVELOPMENT OVERLAY DISTRICT
(P-I/GR&D).
WHEREAS, applications for: (1) an amendment to the zoning ordinance of the City of
;outh San Francisco (the "Zoning Ordinance") adding Chapter 20.39, the "Research and Development" or
'R&D" Overlay District Regulations, (2) an amendment to the Zoning Ordinance adding Chapter 20.40,
the "Genentech R&D Overlay District Regulations" and (3) an amendment of the zoning map of the City of
South San Francisco (the "Zoning Map") from Planned Industrial (P-I) to Planned Industrial/Genentech
Research and Development Overlay District (P-I/GR&D) for the Genentech properties (such properties are
were submitted to the City. The amendments to the Zoning Ordinance and the Zoning Map are sometimes
referred to together herein as the "Project"; and
WHEREAS, an environmental initial study (the "Initial Study") which considered the
potential environmental impacts of the Project was processed and reviewed in accordance with the
California Environmental Quality Act. The Initial Study determined that the Project would not have any
potentially significant impacts on the environment; and
WHEREAS, based upon the Initial Study and other information including, but not limited to,
the East of 101 Area Plan Environmental Impact Report ("Area Plan EIR"), a Negative Declaration was
prepared for the Project pursuant to Pub. Res. Code Section 21080(c)(2) and was made available for public
review pursuant to Pub. Res. Code Sections 21091 et seq.; and
WHEREAS, on January 19, 1995, the Planning Commission of the City of South San
Francisco (the "Planning Commission") held a duly noticed public hearing on the proposed Negative
Declaration and the Project; and
WHEREAS, after having reviewed and considered all evidence and testimony in the record,
the Planning Commission voted to recommend to the City Council of the City of South San Francisco (the
"City Council") adoption of a Negative Declaration for the Project.
NOW, THEREFORE, BE IT RESOLVED that the City Council adopts a Negative
Declaration for the Project based on the following findings:
1. The City Council certified the East of 101 Area Plan EIR and approved the East of
101 Area Plan on July 27, 1994. The East of 101 Area Plan EIR contains a comprehensive review of
potential impacts on the environment from development in the area east of US highway 101, including
development that may occur pursuant to "Facility Master Plans" prepared in accordance with applicable
East of 101 Area Plan policies. The East of 101 Area Plan EIR also incorporates the projected buildout of
the Genentech headquarters facilities that would be permitted by the Genentech Facility Master Plan under
the Project, and analyzes the potential environmental impacts of such buildout under the Project. The
project approvals for the East of 101 Area Plan include the adoption of a broad array of measures designed
to mitigate any environmental impacts of development pursuant to the East of 101 Area Plan, including
those that may result from the Project.
2. In addition, an Initial Study was prepared to consider whether the Project could have
any potentially significant impacts on the environment that were not previously analyzed in the East of 101
-"-krea Plan EIR. For each application for reclassification pursuant to the Zoning Ordinance, project-specific
:nvironmental review will be conducted, as required by CEQA and Area Plan policy IM-12, to consider
0vhether the reclassification involves any potentially significant environmental impacts that were not
analyzed in the East of 101 Area Plan EIR. Regarding the Genentech reclassification, the buildout that
would be permitted pursuant to the project was specifically incorporated into and analyzed under the East of
101 Area Plan EIR. On this basis, the Initial Study determined that there is no substantial evidence that the
Project may have any significant impacts on the environment.
3. Based upon the East of 101 Area Plan EIR, the Initial Study and the entire record
before the City Council, the City Council finds that the Project will not have any impacts that are
individually limited, but cumulatively considerable.
4. Based upon the East of 101 Area Plan EIR, the Initial Study and the entire record
before the City Council, the City Council finds that the Project does not have the potential to result in any
significant impact on the environment.
