HomeMy WebLinkAboutReso 75-1995RESOLUTION NO. 75-95 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING AMENDMENTS TO THE EAST OF 101 AREA PLAN REGARDING DEVELOPMENT IN OPEN SPACE AREAS AND ADJACENT TO KNOWN SENSITIVE RESOURCES WHEREAS, the South San Francisco city Council held a duly noticed public hearing on July 12, 1995 which was continued to July 26, 1995; and WHEREAS, the East of 101 Area Plan is the General Plan for the East of 101 Area and contains the policies for the area governing development in Open Space areas and lands adjacent to known sensitive resources; and WHEREAS, the City Council wishes to provide added opportunity for development in Open Space areas where it can be proven that such development is consistent with the intent of the Open Space land use designation, compatible with Bay Conservation and Development Commission policies and regulations, protective of any sensitive biological resources, and will not have any other adverse impacts including traffic and sewage; and WHEREAS, in order to allow for development in areas East of 101 designated as Open Space, the City Council desires to provide an opportunity for an allocation of a floor area ratio on a case- by-case basis, based on an analysis of potential adverse impacts including traffic, sewage, recreation impacts and impacts to sensitive resources; and WHEREAS, the City Council also wishes to provide flexibility in protecting sensitive resource lands by allowing the opportunity for buffer areas between proposed development and known sensitive resources to be determined based on a site specific biologic resource evaluation; and WHEREAS, a Negative Declaration has been prepared for this amendment in accordance with the California Environmental Quality Act. NOW, THEREFORE, BE IT RESOLVED that the city Council of the city of South San Francisco hereby approves Negative Declaration No. 794, makes the findings set forth therein, and adopts the amendments to the East of 101 Area Plan policies regarding development in Open Space Areas and adjacent to known sensitive resources, attached as Exhibit A. BE IT FURTHER RESOLVED that the resolution shall become effective thirty (30) days after its passage and adoption. l, 1, I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 26th day of July , 1995 by the following vote: AYES: Councilmembers Joseph A. Penna ATTEST: ~ Clerk~~ RESOLUTION NO. 75-95 PROPOSED AMENDMENTS TO EAST OF 101 AREA PLAN OPEN SPACE AND CONSERVATION POLICIES AS APPROVED BY CITY COUNCIL July 26, 1995 Exhibit A Policy LU-10a Uses allowed in the Open Space category shall include parks, vista points, pedestrian and bicycle trail corridors, fishing facilities, playing fields, recreational buildings, interpretive centers, marinas, and undeveloped open space. Further, subject to securing a discretionary permit, development, including accessory parking from adjoining portions of a site may encroach into dry land areas designated Open Space where the dry land area is adjacent to an inland waterway as shown provided that the resulting project incorporates adequate public open space and recreation opportunities consistent with the Open Space land use designation, is compatible with Bay Conservation and Development Commission's policies and regulations, and is protective of sensitive biologic resources. Shoreline Development Guidelines shall be developed to outline public open space/access provisions. Policy LU-10b No Floor Area ratio has been allocated to Open Space designated areas. Dry lands (inland of high tide line) located within Open Space designated areas and adjacent to an inland waterway may receive a Floor Area allocation not to exceed the allowable FAR for the immediately adjacent land use designation, subject to approval of a discretionary permit and an environmental review analyzing any additional adverse impacts including traffic, sewage, and recreation impacts, as well as any impacts to sensitive resources. Policy Con-7 (bullet 2 replacement only) - Provide adequate buffer areas between known sensitive resources and new development. In land areas not adjacent to inland waterways, there shall be a buffer area of at least 100 feet between known sensitive resources and development areas. Buffer areas adjacent to inland waterways should be a minimum 100 feet unless a lesser distance is otherwise approved by the permitting body based on a site specific biologic resource evaluation, consistent with federal and State laws, performed by a qualified biologist.
