CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION APPROVING PLANS AND SPECIFICATIONS,
AUTHORIZING THE WORK AND CALLING BIDS FOR THE
1994-1995 STREET RESURFACING PROGRAM AND
APPROVING CIP-12 TO THE 1994-1995 CAPITAL
IMPROVEMENT BUDGET FOR THE STREET RESURFACING
PROGRAM - GELLERT BOULEVARD (WESTBOROUGH BOULEVARD
TO KING DRIVE AND SOUTH SPRUCE AVENUE (STARLITE
STREET TO HUNTINGTON AVENUE)
WHEREAS, plans and specifications providing
improvement work have been submitted, which
specifications are entitled:
for certain
plans and
1995-1996 STREET RESURFACING PROGRAM

PROJECT NO. ST-95-2
WHEREAS, the City Council desires to approve the plans and
specifications, authorize the work and call for sealed proposals;
and
WHEREAS, funding for the project will require an amendment to
the 1994-1995 Capital Improvement Budget in the amount of $364,000.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of South San Francisco, that:
1. The plans and specifications identified above are
approved and the work provided for is hereby authorized.
2. The Chief Accountant is hereby directed to publish a
notice inviting sealed proposals or bids for the work in accordance
with the plans and specifications on file in the Purchasing Office.
Notice shall be published at least twice not less than five (5)
days apart in the San Mateo Times, a newspaper of general
circulation printed and published in the City of South San
Francisco. The first publication of the notice shall be at least
ten (10) days before the date of opening of the bids.
Ail proposals or bids shall be accompanied by a cashier's
or certified check payable to the order of the City of South San
Francisco in an amount equal to not less than ten percent (10%) of
the bid figure, or by a bond in the amount drawn in favor of the
City and executed by a corporate surety. The check shall be
forfeited by the bidder, or the bond shall become payable to the
City in case the lowest responsible bidder or bidders depositing
the same does not, within the time set forth in the plans and
specifications, enter into a contract with the City. Faithful
performance of the contract shall be guaranteed by an undertaking
in the amount of one hundred percent (100%) of the sum bid, the
undertaking being that of a corporate surety satisfactory to the
city. The contract shall be accompanied by a labor and materials
bond of a corporate surety, also in a sum equal to one hundred
percent (100%) of the amount of the bid for any bid in an amount
not exceeding $5 Million Dollars; and in a sum as required by Civil
Code Section 3248 for any bid in excess of $5 Million Dollars. In
case of a forfeiture, as provided for in the preceding sentence,
the defaulting bidder shall be liable to the City for any
additional expense to which it may reasonably be put in connection
with obtaining full and complete performance of the particular work
of improvement with which this Notice to Bidders is concerned.
3. Bids will be received by the city of South San Francisco,
California, at the Purchasing Office, City Hall Annex, 315 Maple
Avenue, South San Francisco, California 94080, at or before the
hour of 2:00 p.m. on Tuesday the 19th day of September, 1995.
The bids will be publicly opened, examined and declared
at that time in the Conference Room, City Hall, 400 Grand Avenue,
South San Francisco, and award will thereafter be made by the city
Council of the City to the lowest responsible bidder or bidders,
subject, however, to the right of the City Council to reject any
and all bids.
4. The City Council hereby adopts CIP-12 in the amount of
$364,000 of which $114,162 is from the Gellert Boulevard Assessment
District and the remainder from the Gas Tax funds.
I hereby certify that the foregoing Resolution was regularly
introduced and adopted by the city Council of the City of South San
Francisco at a regular meeting held on the 13th day of
