HomeMy WebLinkAboutMinutes 2010-09-22MINUTES CITY COUNC'IlL CITY OF SOUTH SAN FRANCISCO REGULAR MEETING MUNICIPAL SERVICES BUILDING COMMUNITY ROOM 33 ARROYO DRIVE WEDNESDAY, SEPTEMBER 22, 2010 CALL TO ORDER: TIME: 7:08 P. M. ROLL CALL: PRESENT: Councilrrtembers Garbarino and Gonzalez, and Mayor Addiego. PLEDGE OF ALLEGIANCE PRESENTATIONS ABSENT: Councilwoman Matsumoto and Vice Mayor Mullin. Led by Mayor Addiego. • Extension of Downtown Bike Patrol presented by Chief of Police Massoni. Chief of Police Massoni explained that the Downtown Bike Patrol had been performed over the summers for the past 11 years or more. Pursuant to the Program, two (2) officers work the Downtown Corridor addressing quality of life issues. The Program generally runs from the first part of June and ends in September. Begiimiing this year, one (1) of the Officers from the Summer Patrol would remain on the assignment year round. Chief Massoni advised the Officer remaining on the assignment this year had been requested to work 80 hours a pay period with a flexible work schedule designed to address the needs expressed in the area. • Fire Prevention Week Proclamation presented to Fire :Marshal Da Silva. Mayor Addiego presented Fire Marshal Da Silva with a Proclamation establishing October 3rd through 9th as Fire Prevention Week in South San Francisco. Fire Marshal Da Silva thanked Council and advised of the importance of public education regarding home fires and fire escape plans. He advised the Department would. be visiting schools during Fire Prevention Week to educate school children about prevention. and related fire safety issues. AGENDA REVIEW City Manager Nagel advised of no changes to the evening's agenda. At Mayor Addiego's request, he provided a brief summary of discussions with PG~~zE regarding recent reports of potentially risky gas pipelines possibly located in South San Francisco. These reports had surfaced in the news after the San Bruno Fire. City Manal;er Nagel explained that PG&E had released a list of the 100 riskiest lines and South San Francisco did not appear on it. This was somewhat puzzling, since news reports indicated South San Francisco might be on the list. The City would be in continual contact with PG&E seeking answers and remediation of these issues. PG&E would make a presentation to Council at the October 13th Regular Meeting. City Manager Nagel took the opportunity to thank City staff that participated in assisting with the response to the San Bruno Fire. PUBLIC COMMENTS Dalai Metwalli and her daughter presented Council with a~i old picture of the building located at 415 Grand Avenue and owned by Ms. Metwa]~li. She provided information pertaining to the history of the building and her ownership of it. She requested that Council consider her circumstances when taking her building under consideration in Closed Session. City Attorney Mattas advised Ms. Metwalli's building was not the subject of the evening's Closed Session item. Ms. Metwalli complained about citations issued against her property. Mayor Addiego offered to meet with Ms. Metwalli to address her concerns. ITEMS FROM COUNCIL • Announcements. • Committee Reports. Councilmembers reported on participation in community meetings and events including a PAL Boosters Meeting, a HEART Board of Directors Meeting, and the League of California Cities Annual Conference. Parks and Recreation Director Sharon Ranals and her staff were commended for their work on the very successful Day in the Park event. Specific items for further action and/or consideration were set: forth as follows: Councilman Gonzalez thanked Mayor Addiego for helping to bring the 9-11 Memorial Service to City Hall. He commented on the success of the Service and noted that he would like to see it repeated in the future. Councilman Garbarino requested that the meeting be adjourned in honor of Florence Ferko, longtime resident of the City. Mayor Addiego thanked resident Doug Butler for his efforts in putting the 9-11 Memorial Service together. He also thanked City staff and the community for their response to the San Bruno Fire. REGULAR CITY COUNCIL MEETING SEPTEMBER 22, 2010 MINUTES - 2 - CONSENT CALENDAR 1. Motion to approve the minutes of September 8, 2010. 2. Motion to approve expense claims of September 22, 2010. 3. Resolution No. 87-2010 accepting $151,700 from tree State of California under the Office of Traffic Safety -DUI Enforcement and Awareness Program and amending the Police Department's 2010/2011 Operating Budget. 4. Appointment of Regular and Alternate Director to ABAG Plan Board of Directors. 5. Resolution No. 88-2010 authorizing the City Managc;r to execute an agreement with Simpler Systems in an amount not to exceed $37,000 for hosting, design and maintenance services for an enhanced reporting program for the financial system. 6. Resolution No. 89 -2010 rejecting all bids for the Orange Memorial Park Swimming Pool Boiler Replacement Project No. 510-99999-PF1103. Motion- Councilman Garbarino/Second- Councilman Gonzalez: to approve Consent Calendar Items Nos. 1, 2, 4 and 5. AYES: Councilmen Gonzalez and Garbarino and Mayor Addiego; NOES: None; ABSTAIN: None; ABSEN'C: Councilwoman Matsumoto and Vice Mayor Mullin. Item No. 3: Mayor Addiego pointed out that DUI check points catch people driving on a suspended license more frequently than they catch actual drunk drivers. He questioned the location of the DUI Checkpoints and whether the Police Department was required to provide advance notice of them. Chief of Police Massoni responded that the checkpoints frequently catch persons driving without a license or on a suspended license. He also noted thhat the checkpoints are placed on thoroughfares that serve as exit and entry points to the City. He further advised that the Department is required by law to provide advanced notice of DUI checkpoint locations and to provide an out to persons who might happen to drive in the direction of a checkpoint. Motion- Councilman Gonzalez/Second- Councilman Garbarino: to approve Resolution No. 87-2010. AYES: Councilmen Gonzalez and Garbarino and Mayor Addiego; NOES: None; ABSTAIN: None; ABSENT: Councilwoman Matsumoto and Vice Mayor Mullin. Item No. 6: Councilman Gonzalez questioned why the bids were being rejected since Council had accepted a bid at its last meeting. Director of Parks and Recreation Ranals explained that after Council approved the project, the Company advised staff that the selected boiler was no longer being recommended for installation in swimming pools. AYES: Councilmen Gonzalez and Garbarino and Mayor Addiego; NOES: None; ABSTAIN: None; ABSENT: Councilwoman Matsumoto and Vice Mayor Mullin. PUBLIC HEARING 7. Resolution No. 90-2010 authorizing submittal of the 1009-2010 Consolidated Annual Performance and Evaluation Report (CAPER) to the Department of Housing and Urban Development (HUD). Public Hearing opened: 7:49 p.m. Community Development Coordinator Adams provided a brief summary of the Consolidated Annual Performance and Evaluation Report: and reported on annual goals. This year's programs served over 1500 individuals. Several home owners and businesses were helped with loans and building improvements. Housing services and other community outreach services were also provided. public Hearing closed: 7:51 p.m. Mayor Addiego thanked Coordinator Adams for her presentation and for assistance he witnessed her provide to a resident late on a Friday afternoon. Motion- Councilman Gonzalez/Second- Councilman Gart-arino: to approve Resolution No. 90-2010. AYES: Councilmen Gonzalez and Garbarino and Mayor Addiego; NOES: None; ABSTAIN: None; ABSENT: Councilwoman Matsumoto and Vice Mayor Mullin. ADMINISTRATIVE BUSINESS 8. Approval of required response to the San Mateo County Grand Jury regarding Sex Offender Law Enforcement in San Mateo County. Chief of Police Massoni presented the report form the GranCl Jury regarding the regulation of sexual predators in the County. He explained each city received the same report. The cities joined together to prepare a response. Accordingly,,thE; proposed response letter was the same response being presented to other City Councils in the County. Councilman Garbarino noted that pursuant to website information, approximately 200 sexual predators were located in South San Francisco. Chief Massoni advised South San Francisco's Hotel Strip was a location where many such individuals could live due to its distance from schools. Motion- Councilman Gonzalez/Second- Councilman Garbarino: to approve the required response to the San Mateo County Grand Jury regarding Sfax Offender Law Enforcement in San Mateo County. AYES: Councilmen Gonzalez and G~rrbarino and Mayor Addiego; NOES: None; ABSTAIN: None; ABSENT: Councilwoman Matsumoto and Vice Mayor Mullin. Conference with Legal Counsel Anticipated Litigation Initiation of litigation pursuant 1:o subdivision (c) of Section 54956.9: 1 case. Cllosed Session opened: 7:55 p.m. Open. Session Resumed: 8:00 p.m. Report out of Closed Session by Mayor Addiego: Council authorized the City to file a claim with the State Unfunded Mandate Commission regarding NPDES Permit Compliance cost. ADJOURNMENT Being no further business, Mayor Addiego adjourned the meeting at 8:00 P.M. in honor of Florence Ferko.
