HomeMy WebLinkAboutReso 139-1993RESOLUTION NO. 139-93 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ADOPTING AGREEMENT BETWEEN SOUTH SAN FRANCISCO AND MILLBRAE TO IMPLEMENT SOLID WASTE AND HOUSEHOLD HAZARDOUS WASTE PROGRAMS WHEREAS, Assembly Bill No. 939 requires local jurisdictions to reduce their solid waste disposal by 25% by 1995 and 50% by the year 2000; and WHEREAS, the City of South San Francisco and the City of Millbrae have adopted the Source Reduction and Recycling Element (SRRE) and Household Hazardous Waste Element (HHWE); and WHEREAS, the City of South San Francisco and the City of Millbrae have developed an Agreement to implement each of the City's Solid Waste Management Programs; and WHEREAS, the purpose of the Agreement is to provide a coordinated program between the Cities to implement their solid waste reduction, recycling and public information activities; and WHEREAS, each City to the Agreement will pay its proportionate share of the costs of the program as specified in the Agreement; and WHEREAS, the Program will be implemented by a Program Coordinator as the "Solid Waste Coordinator" who will work with a committee of representatives for both cities. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that: 1) The Agreement between the Cities of South San Francisco and Millbrae for Implementation of Solid Waste Management Programs is hereby approved. (Copy attached as Exhibit "A") 2) The City Manager is authorized to execute the same. 3) The City Manager is authorized to expend up to $22,427.00 to implement the Program. Fernekes NOES: N0ne ABSTAIN: None ABSENT: None ATTEST: Solid Waste EXHIBIT A TO RESOLUTION NO. 139-93 AGREEMENT BETWEEN THE CITIES OF SOUTH SAN FRANCISCO AND MILLBRAE RELATING TO IMPLEMENTATION OF SOLID WASTE MANAGEMENT PROGRAMS This Agreement, dated , is by and between the City of South San Francisco (hereinafte- South San Francisco), and the City of Millbrae (hereinafter Millbrae), for implementztion of each city's solid waste management programs involving the Source Reduction and Recyct'.ng Element and Household Hazardous Waste Element to comply with the provisions of the California Integrated Waste Management Act of 1989 (AB939). RECITALS The California Integrated Waste Management Act of 1989 ('Act"), Public Resources Code Section 40000 et seq., declares that the responsibility for solid waste management is to be shared between the state and local government. The Act requires each city to prepare, adopt and submit to the County a Source Reduction and Recycling Element. Each city entered into an agreement, and in a joint effort, prepared their respective SRRE's and adopted them. Cities wish to cooperate in implementing and operating their own solid waste management programs. NOW THEREFORE, the parties agree as follows: The purpose of this Agreement is to provide a coordinated program among the cities in implementing their solid waste activities such as source reduction, recycling, and public information/education, as well as allocation of costs among the cities. There will also be a Steering Committee comprised of members from each city to oversee the program and evaluate its performance. 2. Responsibilities of Each City Ao Each city shah participate in the selection of a Solid Waste Coordinator who will be employed by the City of South San Francisco. Day-to-day supervision will be administered by the Director of Public Works office, which will also provide office space and transportation. Bo In addition to implementing their own programs, each city shall assign adequate staff, to participate on the Steering Committee. The Steering Committee will guide the Solid Waste Coordinator's activities. A decision to expand mutually shared staffing resources may be reached by mutual agreement. South San Francisco shall be the lead agency in administering the Agreement, and will invoice Millbrae quarterly, payable in thirty (30) days. Cos: Allocation The total anticipated cost of the program is $34,400. Costs shall be allocated as follows: Forty-five percent (45%) of the cost will be paid in equal portions by each city. The remaining fifty-five percent (55%) will be paid according to each city's proportionate amount of the total waste disposal from both cities. The percentage of the total waste disposal from each city is: South San Francisco 77.6% Millbrae 22.4% Therefore, total cost allocations for each city will be: City Initial 45 % Remaining 55 % Cost Allocation South San Francisco 50% 77.6% 65.2% Mil_brae 50% 22.4% 34.8% 100.0% Based upon $34,400 program cost, the per city costs are: South San Francisco $22,427 Millbrae $11,973 If 1Lae anticipated costs change by more than fifteen percent (15%) or the assumptions used to determine the cost allocation require modification, then the method of allocating cosl~ is subject to amendment, by an approved written supplement to this Agreement. For subsequent Agreements, cost allocations will be modified to reflect implementation of cae Program. Mu.ual costs (Solid Waste Coordinator, office space, transportation expenses, reports, brochures, etc.) that both cities use will be shared. In addition, each city may require unique materials developed specifically for them, and completely at their expense. SoEd Waste Coordinator's Work The Solid Waste Coordinator will work and coordinate with Cities' staffs, South San Fraqcisco Scavenger, Inc., the County of San Mateo, and/or regional or sub-regional muMcipal organizations in the development and implementation of solid and household hazardous waste programs as described in the Cities' Source Reduction and Recycling Ele_nent and Household Hazardous Waste Element. This person will represent cities on committees, task forces at the local and regional level, and will develop action plans for eacla city setting out goals, actions, responsibilities and schedule for developing and implementing each City's SRRE and HHWE. The Coordinator will be in contact and work directly with businesses, schools, and multi-family residential complexes to accomplish the development and implementation of programs. The Solid Waste Coordinator will be involved with both cities, working together on rel~.ted products (brochures, etc.). It should be anticipated that one city may require exc usive or special attention due to a particular situation pertaining to that city. Let gth of Term This Agreement shall commence on January 1, 1994 and shall continue through June 30, 1994, unless terminated earlier by mutual agreement of the parties. The Agreement will be renewed each fiscal year as part of the budget process. Any one of the two cities that does not wish to renew the Agreement is to submit thirty (30) days notice. Notices The cities designate the following persons to act as authorized representatives in matters peraining to the performance of this Agreement.
