CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AUTHORIZING A LICENSE AGREEMENT
WITH THE HOMART DEVELOPMENT COMPANY REGARDING
THE OYSTER POINT INTERCHANGE PROJECT AND
APPROVING BUDGET AMENDMENT CIP 94-5 TO THE
1993-1994 CAPITAL IMPROVEMENT BUDGET
WHEREAS, the construction of the Oyster Point Interchange
Project ialong Oyster Point Boulevard bordering property owned by
the Homart Development Company will create a valley between Oyster
Point BoUlevard and the existing slope on the Homart Property; and
WHEREAS, a change order has been negotiated with the
Contractor, Oliver DeSilva, to fill in the valley and complete the
work for! an estimated $232,277; and
WHEREAS, costs related to the construction of the Oyster Point
Interchange Project are allowed uses for Gateway Assessment
District Funds; and
WHEREAS, the Amended and Restated Owner Participation
Agreement between the Redevelopment Agency, the City of South San
Francisco and Homart Development Company provides that the
remaining Gateway Assessment District funds may be used for the
Oyster Point Interchange Construction Project; and
WHEREAS, an additional $250,000 will be needed to perform the
work leaving an unappropriated balance of $950,000 in the fund to
do other! District work in the future.
WHEREAS, a License Agreement has been prepared with Homart
giving the City permission to enter upon and work on their
property.
NOWi, THEREFORE, BE IT RESOLVED by the City Council of the City
of South San Francisco that:
1. It hereby authorizes the appropriation of an additional
$250,000i of uncommitted Gateway Assessment District Construction
funds to, the 1993-1994 Capital Improvement Budget for construction
costs on. the Oyster Point Interchange Project.
2. The City Manager is further authorized to execute any and
all documents necessary on behalf of the City to further this
Project. A copy of the License Agreement is on file in the Office
of the City Clerk.
