HomeMy WebLinkAboutReso 26-1993RESOLUTION NO. 26-93 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION RESCINDING RESOLUTION NO. 181-86 AND AUTHORIZING DISPERSAL OF CULTURAL EVENTS TRUST FUNDS WHEREAS, the Cultural Events Trust Fund contains a balance of $19,824.00; and WHEREAS, Resolution No. 181-86 provided for the creation of a Cultural Events Committee (C.E.C.) to serve as advisors to the Council; and WHEREAS, such Committee was never appointed and has never provided advice to the Council; and WHEREAS, the City Council desires to earmark the fund balance to aid Art Rise in the construction of a theater in Orange Memorial Park and does not wish to constitute the C.E.C. to provide additional guidance in this matter; and WHEREAS, the Council wishes to clear up any inconsistency with Resolution No. 6-93. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco as follows: 1. The sum of $10,000 in the Cultural Events Trust Fund shall be earmarked for a period of three (3) years as aid to Art Rise for the purpose of constructing a theater facility in Orange Memorial Park. If Art Rise shows proof that it has raised $250,000 during the initial three year period, the $10,000 sum shall remain earmarked for an additional two (2) years. 2. Within the five (5) year period, the funds shall be released to Art Rise upon proof of all of the following: (a) Sufficient funds have been raised by Art Rise to complete construction of the proposed theater; and (b) A contract has been awarded for the construction of such theater; and (c) Faithful Performance, Completion and Material and Labor Bonds have been approved by the City Attorney. 3. Resolution No. 6-93's reference to the theater being constructed at no cost to the City is hereby rescinded insofar as it is inconsistent with this resolution. 4. Resolution No. 182-86 is hereby repealed except for the provisions creating the cultural Events Trust Fund. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 24th day of FebrJar¥ , 1993 by the following vote: AYES: Councilmembers Jack Drago, Joseph A.
