A RESOLUTION OF INTENTION TO ORDER
IMPROVEMENTS AND LEVY ASSESSMENTS
AND PROVIDING FOR HEARING AND NOTICE
FOR THE CITY OF SOUTH SAN FRANCISCO
WEST PARK 1 & 2 PARKS AND PARKWAYS
MAINTENANCE DISTRICT
BE 5T RESOLVED by the City Council of the City of South San
Francisco that:
1. On April 28, 1993, this Council adopted A Resolution
Directin~ Preparation of Annual Report of the City of South San
Francisco West Park 1 & 2 Parks and Parkways Maintenance District
(the "District"). Pursuant to this resolution, Barry Nagel, as
Engineer of Work, prepared a report in accordance with Section
22565, et seq., of the California Streets and Highways Code (the
"Report"). The report has been made, filed with the City Clerk and
duly considered by this Council and is hereby deemed sufficient and
preliminarily approved. The report shall stand as the Engineer's
Report for all subsequent proceedings under and pursuant to the
foregoin~ resolution.
2. It is the intention of this Council to levy and collect
assessments within the District for the fiscal year 1993-1994.
Within the District, the existing and proposed improvements and any
substantial changes proposed to be made to the existing
improvements are generally as described on Exhibit "A" attached and
by this reference made a part of this Resolution.
3. The District consists of the lots and parcels shown on
the boundary map of the District on file with the City Clerk of the
City and reference is hereby made to such map for further
particulars.
4. The amount of the proposed assessment for fiscal year
1993-94 per parcel is $54.00 per unit; however, for property owners
who were parties to the Westborough Litigation, settlement proceeds
will be applied to reduce their 1993-94 assessment to $0. The
mailing kabel attached to the copy of this Resolution mailed to
each property owner pursuant to Section 7 will show their amount of
the assessment per parcel for fiscal year 1993-94.
5. Reference is hereby made to the Report, on file with the
city Clerk, for a full and detailed description of the
improvements, the boundaries of the District and the proposed
assessments upon assessable lots and parcels of land within the
District.
6. This Council hereby orders that two public hearings shall
be held before this Council in the regular meeting place thereof at
the MunLcipal Services Building, 33 Arroyo Drive, South San
Francisco, California as follows:
a. The first hearing shall be held on June 9, 1993, at
the hour of 7:30 o'clock p.m. for the purpose of allowing public
testimony regarding the levy of the proposed assessments; provided,
however, that at said first hearing, no action shall be taken to
levy the proposed assessment; and
b. The second hearing shall be held on June 23, 1993,
at the hour of 7:30 o'clock p.m. for the purposes of this Council's
determination whether the public interest, convenience and
necessity require that the proposed levy be made, and this
Council's final action upon the Report and the assessment therein.
At the hearing, any interested person may protest the
proposed assessment. In addition, prior to the conclusion of the
second hearing any interested person may file a written protest
with the City Clerk, 400 Grand Avenue, South San Francisco,
CalifornSa 94080; or having previously filed a protest, may file a
written withdrawal of that protest. A written protest shall state
all grounds of objection. A protest by a property owner shall
contain a description sufficient to identify the property owned by
that owner.
7. The Clerk shall cause notice of the hearings to be given
in each of the following ways:
a. By publishing at least ten (10) days prior to the
date of the first hearing specified in this Resolution a copy of
this Resolution once, in the Enterprise-Journal, a newspaper
circulated in the City of South San Francisco.
b. By mailing at least forty-five (45) days prior to
the date of the second hearing specified in this Resolution a copy
of this Resolution by first class mail, postage prepaid to each
property owner, whether resident or non-resident, of property to be
assessed at their address as it appears on the last equalized
County assessment roll or the State Board of Equalization
assessment roll, or as known to the City Clerk, or to both if not
the same.

introduced and adopted by the City Council of the City of South San
