CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AUTHORIZING EXECUTION OF
THE OYSTER POINT INTERCHANGE FUND
TRANSFER AGREEMENT
WHEREAS, the City certifies that all reasonable steps have
been completed to assure full due diligence in the discovery of
hazardous wastes during the acquisition of the project's right-of-
way, and the State is held harmless from cleanup liability or
damages, both present and future; and
WHEREAS, the City certifies that it will not seek further
State funding for cleanup, damages, or liability cost associated
with hazardous waste on or below the acquired properties' surface;
and
WHEREAS, the City certifies that it will not adopt new or
increased development taxes, fees, exactions, or permit fees for
the purpose of providing local matching funds; and
WHEREAS, the City shall be responsible for all costs of
contaminated materials cleanup as required by the project
construction and regulatory agencies, and no State funds shall be
used for any hazardous or contaminated material cleanup costs.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of South San Francisco, that:
The City Manager is authorized to execute an Agreement on
behalf of the City of South San Francisco with the State of
California for $6,905,000.00 in State Railroad Bond Funds for the
Oyster ~oint Interchange construction, under the terms and
conditions as set forth in this Agreement on file in the Office of
the City Clerk.
I hereby certify that the foregoing Resolution was regularly
introduced and adopted by the City Council of the City of South San
Francisco at a rpgular meeting held on the 9th day of
December , 1992 by the following vote.
