HomeMy WebLinkAboutReso 21-1992RESOLUTION NO. 21-92 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION OF INTENTION TO FORM AN UNDERGROUND UTILITY DISTRICT, AND CALLING FOR A PUBLIC HEARING TO DETERMINE WHETHER OR NOT THE PUBLIC HEALTH, SAFETY OR WELFARE REQUIRES THE FORMATION OF SAID AIRPORT BOULEVARD UNDERGROUND UTILITY DISTRICT NO.2 WHEREAS, Division 12 of the Streets and Highways Code, applicable provisions of Division 7 of the Streets and Highways Code and Chapter 13.16 of the South San Francisco Municipal Code set forth the procedure for the creation of Underground Utility Districts; .and WHEREAS, the aforementioned laws require as the initial step 5n such procedure the adoption of a Resolution of IntentSon followed by the holding of a Public Hearing to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communScation or similar or associated services in any such district; and WHEREAS, this Council is informed that Pacific Gas and ElectrLc Company (hereinafter "PG&E") has voluntarily agreed to pay the entire cost of undergrounding work by using monies from its RuLe No. 20A Fund, including the costs of installing users' underground electric service laterals. WHEREAS, the Council is also informed that Pacific Bell has voluntarily agreed to pay the entire cost of undergrounding work Ln accordance with California State Public Utility Commission Rule No. 32A, including the costs of installing users' underground communication service laterals. NOW, THEREFORE, BE IT RESOLVED by the City Council of the city of South San Francisco that: 1. The City Council determines that public utilities, to wit: PG&E and Pacific Bell have voluntarily agreed to pay all the costs of conversion, including costs of users' underground electrLc or communication service laterals. 2. The City Council hereby declares its intention to establLsh an Underground Utility District entitled "Airport Boulevard Underground Utility District No. 2", the boundaries of which district are more particularly described in Exhibit "A" at~ached hereto and by this reference incorporated herein as thc.ugh set forth verbatim and to order the conversion described in Exhibit "B" attached hereto and by this reference incorporated herein as though set forth verbatim. 3. NOTICE IS HEREBY GIVEN that a public hearing will beheld by the City council of the City of South San Francisco on Wednesday, the 22nd day of April, 1992, at the hour of 7:30 p.m. in the Community Room of the Municipal Services Building, 33 Arroyo Drive, South San Francisco, California, 94080, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated structures and the underground installation of wires and facilities for supplying electric, communication or similar associated services in the District hereinabove descriDed. 4. At such hearing, all persons interested shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the city Council. 5. The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned of the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least thirty (30) days prior to the date thereof. 6. The City Clerk shall publish a Notice of Hearing once thirty (30) days prior to the date of the hearing in the Enterprise-Journal, a newspaper of general circulation, published and circulated regularly in the City of South San Francisco. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a re§u]ar meeting held on the llth day of March , 1992 by the following vote: AYES: Councilmembers Jack Drago, Joseph A. Penna NOES: None ABSTAIN: None ABSENT: None · .lgfrl~l'T "~., t~EBOLDTIOI~ I'I0. 21-92 CONVERSION OF FACILITIES AIRPORT BOULEVARD UNDERGROUND UTILITY DISTRICT NO. 2 The removal of poles and overhead wires and associated overhead structures including poles, towers, supports, wires, conductors, guys, stubs, platforms, crossarms, braces, transformers, insulators, cutouts, switches, communication circuits, appliances, attachments, and appurtenances located above ground and used or usefL1 in supplying electric, communication or similar or associates services and the underground installation of wires, conduits, splice boxes, transformers and other appliances and appurtenances necessary for supplying electric, comnunication or similar or associated service, in accordance with the regulations ard procedures established by Ordinance No. 566 of the City of South San Francisco adopted August 17, lg67, from $0' to the westerly side of Airport Boulevard and along the easterly side of Airport Boulevard and between 100' north of Grand AvenLe to the northerly City limits as shown on the map titled "Airport Boulevard Underground Utility District No. 2", revised January 2, lggO, all within the prcposed district located in the City of South San Francisco, County of San Mateo, State of California. "Excepting from this district those certain overhead electric facilities of the Pacific Gas and Electric Company that cross both Airport )oulevard and U.S. Highway No. 101 between Armour and Linden Avenue, including all poles, towers, risers, wires, and appurtenances thereto."
