HomeMy WebLinkAboutReso 49-1992 RESOLUTION NO. 49-92 CITY COUA'CIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION DESIGNATING C/CAG AS PROGRAM MANAGER FOR SAN MATEO COUNTY FOR ASSEMBLY BILL 434 FUNDS WHEREAS, on October 10, 1991, the State of California enacted Assembly Bill 434 authorizing the Bay Area Air Quality Management District to impose a fee on motor vehicles to be used for specified transportation control projects and programs to implement the California Clean Air act of 1988; and WHEREAS, Assembly Bill 434 provides that not less than forty percent of the fee revenues generated in each county within the Bay Area Quality Management District shall be allocated for programs in that county to an entity designated as the overall program manager by the co'anty board of supervisors and city councils for a majority of the cities representing a majority of the population in the incorporated areas of the county; and WHEREAS, the City Council desires to designate the City/County Association of Governments ("C/CAG"), of San Mateo County as the sole pro~ram manager in San Mateo County for the allocation and expenditure of funds generated pursuant to Assembly Bill 434, accordin~ to the terms and conditions of the attached policy entitled, "City/County Association of Governments: Policy on Administration of AB 434." NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South Francisco that the City/County Association of Governments is designated as the sole program manager in San Mateo County for the allocation and expenditure of funds generated pursuant to Assembly Bill 434; and BE IT FURTHER RESOLVED that the allocation and expenditure of funds generated pursuant to Assembly Bill 434 shall be governed by the terms and conditions of the attached policy entitled "City/County Association of Governments: Policy on Administration of AB 434." Penna None None Councilmember Roberta Cerri Te§lia ATTEST: ~erf~ RESOLUTION NO. 49-92 CITY/COUNTY ASSOCIATION OF GOVERNMENTS POLICY ON ADMINISTRATION OF AB 434 INTRODUCTION The purpose of this policy is to provide guidance and direction for the administration of AB 434 funds. AB 434 provides authority to the Bay Area Air Quality Management District (BAAQMD) to impose a $2.00 surcharge fee on motor vehicles registered within the BAAQMD to become effective April 1, 1992. This fee can be raised to $4.00 effective October 1, 1992, or thereafter by resolution of the BAAQMD. The fee is collected by the Department of Motor Vehicles and distributed to the Bay Area Air Quality Management District. The funds are then divided into two separate categories: 1) 60% is administered by BAAQMD, 2) 40% is reserved for the County Program Manager. AB 434 specifies seven types of transportation projects or programs. These projects are listed in the eligibility criteria section of this policy. Only public agencies are eligible to receive funding. To administer the program, the County Program Manager will be allowed to use the entire administrative budget allowed by law (5%). Therefore any administrative cost incurred by a successful claimant will have to be financed by that claimant. PROGRAM OBJECTIVES The following objectives will be used by C/CAG in evaluating projects. The objectives are used to establish eligibility criteria and priorities. 1. Reduce air pollution from motor vehicles. Fund the most effective transportation programs and projects that achieve emission reductions from motor vehicles, pursuant to the California Clean Air of 1988 and the Bay Area 1991 Clean Air Plan. Implement AB 434 funding as quickly, simply, and efficiently as possible within the constraints of the law. e Be as equitable as possible while continuing to support other program objectives. -1- Se '6. 7. 8. Seek cost/effective programs and projects that will leverage additional funds from other sources. Promote Countywide significant projects. Encourage innovation. Coordinate funding requests in both categories, i.e. 40%, 60% categories. ELIGIBILITY CRITERIA The criteria are based on program objectives and priorities and serve as the minimum criteria for AB 434 funding eligibility. Only public agencies including, but not limited to, cities, counties, school distr~cts, ~ransit districts, regional, state, and other agencies responsible for implementing specified transportation projects or programs are eligible to apply. A public agency may sponsor a funding application for a project that will be jointly implemented through a private/public partnership. The project must meet program objectives and conform with AB 434 and BAAQMD requirements. Projects must be within one of the seven areas listed in AB 434. The following projects are not listed in order of priority. o Ridesharing/trip reduction ordinances/programs o Clean fuel buses o Feeder bus/shuttle service o Local arterial traffic management o Rail/bus integration/regional transit information o Demonstration projects of Telecommuting, congestion pricing and alternative fuel vehicles o Smoking vehicles program -2- ADMINISTRATION San Kateo County Planning staff will be responsible for administering the program. Based on this policy, staff in con" .nction with the CMP Technical Advisory Committee will be res nsible for developing a "scoring system" for evaluating and projects which require C/CAG approval. TAC will lly review applications and provide recommendations to C for final approval. -3-
