ROLL CALL: PRESENT: Councilmembers Addiego Gonzalez; and Matsumoto, Vice Mayor Garbarino and Mayor Mullin. PLEDGE OF ALLEGIANCE: Led by Mayor Mullin PRESENTATIONS • Helen Putnam Award Presentation. Parks and Recreation Director Sharon Ranals accepted the Ilelen Putnam Award for the City's installation of Centennial Way from Rebecca Elliot of the League of California Cities. Ms. Elliot explained the award's prestige and explained its namesake, Helen Putnam, was a mother, school teacher, principal, mayor and county supervisor who put community excellence first. South San Francisco was one of 10 nominees out of 117 to win the award. Director Ranals issued a heartfelt thank you to the league, members of council and the excellent city staff that work to continually enhance the quality of life for residents. She commended City Manager Barry Nagel who was the Director of Parks and Recreation when the vision for Centennial Way was originally instilled.. Councilwoman Matsumoto thanked Ms. Elliot for her tireless work at the League. AGENDA REVIEW None. PUBLIC COMMENTS Regina Martin of HIP Housing thanked Council far its continued support of HII''s programs. Because of community support HIP is able to provide over a thousand individuals with a place to call home. San Mateo County students from Kindergarten through 8th grade drew pictures depicting what home moans to them. Several were selected for inclusion in the housing calendar that was being distributed to Council that evening. Amanda from Seising from South San Francisco, whose drawing was selected, read the caption under her entry in the calendar, which stated "my home means shelter to me it means everything to me." ITEMS FROM COUNCIL • Announcements. • Committee Reports. Councilmembers reported on attendance at community meetings and events, including a HEART Meeting, a meeting of the League of California Cities, a Woman's Club breakfast. Announcements were made regarding the CPTF eWaste event that would take place on January 21St and 22"d at the Main Fire Station. CouncilmembE°rs congratulated Vice Mayor Garbarino and Mayor Mullin on their appointments to the respective seats. Council further congratulated staff and Executive Assistant to the City Manager Irene Soto for the successful Reorganization event. Specific items for further action and/or consideration were set forth as follows: Councilman Addiego commended the community online news website patch.com for its coverage of South San Francisco. He further recognized the group Alice.org for its work against domestic violence. He stated he would like to see thf; group considered for CDBG funding in the upcoming year. Councilwoman Matsumoto requested that the meeting be adjourned in honor of Ada Nicolopulos. She noted Ada had been a pillar of the community alongside her husband Gus who had served as a Policeman and Councilman within the City. Vice Mayor Garbarino requested that the meeting be adjourned in honor of his neighbor and friend Katherine M. Bartolotti. • City Selection Committee appointments. Council considered the submissions for various seats and committee appointments that would be votes on at the Council of Cities meetings. Council. agreed to support the following candidates during the first round of voting: California Identification System (CAL-ID) - Councilmember Elect Kirsten Keith, Menlo Park Local Agency Formation Commission (LAFco) - Councilmember Richard Garbarino, City of South San Francisco San Mateo County Transit District (SamTrans) Northern Cities - Councilmember Karyl Matsumoto, City of South San .Francisco Central Cities - Vice Mayor Jerry Deal, City of Burlingame REGULAR CITY COUNCIL MEETING DECEMBER 8, 2010 MINUTES - 2 - San Mateo County Transportation. Authority (SMCTA) Southern Cities - Councilmember Rosanne Foust, City of Redwood City Central Cities - Mayor Terry Nagel, City of Burlingame • Consideration of letter to California High Speed Rail Authority. Mayor Mullin explained the proposed letter would be signed by various cities in the region and reiterates concerns pertaining to High Speed Rail. With modifications relating to the last bullet point, Council agreed to sign on to the letter. CONSENT CALENDAR 1. Motion to approve the minutes of November 10, 2010, 2. Motion to approve expense claims of December 8, 2010.. 3. Resolution No. 99-2010 authorizing the execution and delivery of a lease with option to purchase; the execution of a copier maintenance agreement and an equipment purchase agreement; and authorizing certain actions in connection therewith. 4. Resolution No. 100-2010 awarding the Orange Memorial Park Swimming Pool Boiler Replacement Project No. 510-99999-pfl 103 to City Mechanical, Incorporated of Hercules, CA in the amount of $34,884.60. 5. Resolution No. 101-2010 approving a Memorandum of Agreement with the City and County of San Francisco for the Crystal Springs Pipeline No. 2 Replacement Project; and adopting responsible agency findings. 6. Resolution No. 102-2010 awarding the construction contract to St. Francis Electric of San Leandro, California, for the East Grand Avenue- Haskins Way Traffic Signals Installation Project (Project No. 510-99999-trlOll) in an amount not to exceed $131,892 and rejecting the bid protest. 7. Resolution No. 103-2010 authorizing the acceptance of $2,914.56 from the Office of Traffic Safety (OTS) in grant funding for seatbelt enforcement during the "Click It or Ticket" campaign. and amending the Police Department's 2010/11 Operating Budget. 8. Resolution No. 104-2010 approving Supplement No. 8 to the Agreement for sewage disposal with the North San Mateo County Sanitation Diistrict. 9. Notification of Appeal and action on recommendation that hearing be delayed for appeal of the Planning Commission's approval of a LJse Permit, Design Review, and Parking reduction to allow the Society of St. Vincent de Paul to operate a charitable food and support services facility at 938 Linden Avenue in the Downtown Mixed Use Zone (DMX) District, in accordance with SSFMC Section 20.570.004. REGULAR CITY COUNCIL MEETING DECEMBER 8, 2010 MINUTES - 3 - 10. Resolution No. 105-2010 adopting a new section 125 Flexible Benefits Plan and plan administrator and authorizing city staff to administer plan. Motion- Councilman Gonzalez/Second- Councilwoman Matsumoto: to approve consent Calendar Items Nos. 1, 2, 3, 5, 7, 8, & 10. Unanimously approved by voice vote. Motion- Councilman Gonzalez/Second- Councilwoman Matsumoto: to approve consent Calendar Item No. 9. AYES: Councilmembers Gonzalez ;end Matsumoto, Vice Mayor Garbarino and Mayor Mullin. NOES: None. ABSTAIN: Councilman Addiego. ABSENT: None. Item 4: Councilman Gonzalez questioned whether the selected boiler was tankless. Director of Parks and Recreation Ranals so confirmed. Motion- Councilman Gonzalez/Second- Councilman Addiego: to approve Consent Calendar item no. 4. Unanimously approved by voice vote. Item No. 6: In response to a question from Councilwoman Matsumoto that was not determinative with respect to the Resolution at issue, City Attorney Mattas stated he would provide a clarifying memo related to proposition 209 and the uocal hiring requirement. Mayor Mullin suggested agendizing a discussion of Proposition 209 requirements at the upcoming City Council retreat. Motion- Councilwoman/Second- Councilman Gonzalez: to approve Consent Calendar item no. 6. Unanimously approved by voice vote. LEGISLATIVE BUSINESS 11. Waive reading and introduce an Ordinance Repealing Chapters 15.06, 15.08, 15.12, 15.16, and 15.20 of the South San Francisco Municipal Code; and adopting Chapters 15.06 (Uniform Administrative Code), 15.08 (California Building Code), 15.12 (California Plumbing Code), 15.16 (California Mechanical Code), 15.20 (California Electrical Code), 15.22 (California Green Building Standards Code), and 15.26 (California Energy Code) of the South San Francisco Municipal Code in order to adopt by reference and amend provisions of the 2010 Edition of the California Building Standards Code, Title 24, California Code of Regulations; and set public hearing on the record for adoption. City Building official Kirkman presented the staff report recommending the waiver of reading and introduction of an ordinance adopting the California building Codes with local amendments. He noted that several new codes, including the green and residential codes, had been established since the last time Council visited the issue. He explained certain amendments included recommendations for the plumbing code with respect to the type of pipe utilized. He recommended that Council set a public hearing to move forward with adoption of the code. REGULAR CITY COUNCIL MEETING DECEMBER 8, 2010 MINUTES - 4 - Councilwoman Matsumoto requested clarification with respect to some of the geographical elements unique to the City. Building Official Kirkman responded that the major issue is that the San Andreas Fault is in the City's back yard. Further, the weather to the West of 280 played into certain requirements. Mayor Mullin questioned whether there were any local amendments being proposed to the California green building codes. He further questioned whether Council could supersede the state green codes if it believed the codes were not strong enough. Building Official Kirkman advised there were local amendments proposed to the pluming, building and residential codes. However, the state language was being wholly adopted with respect to the green code. If Council wanted different policy with respect to the green codes, they would come back as local amendments. Vice Mayor Garbarino questioned whether smoke alarms were going to be required to have carbon monoxide detectors. City Building Official Kirkman confirmed carbon monoxide detectors would be required on smoke alarms. Waive reading and introduce an Ordinance repealing Chapter 15.24 of the South San Francisco Municipal Code; and adopting Chapter 15.24 (Fire Code) of the South San Francisco Municipal Code in order to adopt by refere~ice and amend provisions of the 2010 Edition of the California Fire Code; and set public hearing on the record for adoption. Fire Marshal Da Silva presented the staff report and explained the Fire Code is on the same three year cycle as the building codes. The proposed amendments would streamline the administrative processes, including clarifying the appeals process. The amendments were also designed to address local climate, topographical and geographical conditions and dictate more stringent related requirements. Councilwoman Matsumoto questioned whether existing differences between the fire and building codes would be resolved. REGULAR CITY COUNCIL MEETING DECEMBER 8, 2010 MINUTES - 5 - Fire Marshal Da Silva responded that the proposed codes synthesize the requirements and would alleviate the present issues. City Manager Nagel explained the Building and Fire Departments worked closely on the amendments. Motion- Councilwoman Matsumoto/Second- Councilman Gonzalez: to waive reading and introduce an Ordinance repealing Chapter 15.24 of the South San Francisco Municipal Code; and adopting Chapter 15.24 (Fire Code) of the South San Francisco Municipal Code in order to adopt by reference and amend provisions of the 201.0 Edition of the California Fire Code; and set public hearing for January 12, 2010 f©r adoption. Unanimously approved by voice vote. ADMINISTRATIVE BUSINESS 13. Resolution No. 106-2010 authorizing the City of Soutli San Francisco to become a member of a countywide sub-region, an entity that would locally administer Association of Bay Area Government's (ABAG'S) Regional Housing Needs Allocation Process (RHNA) as part of the regional Sustainable Communities Strategy (SCS). Chief Planner Kalkin explained that as part of the last housing element update in 2007, the City of South San Francisco joined with the County and other cities to form asub-region to jointly receive and distribute the regional housing needs allocation distribution on a local basis. While the overall allocation is still designated by the ABAG Board the arrangement permits the participating cities to negotiate to suit their particular needs. CCAG is recommending that cities and counties utilize the same structure for the next regional housing needs allocation process. Accordingly, staff recommended that Council adopt a resolution supporting the City's membership in the sub-region. Councilwoman Matsumoto expressed concern over the issuance of building credits. Chief Planner Kalkin stated the issues of allocation and credit were not directly related. But staff would pay attention to the beginning projections for housing and jobs growth and how it would affect the credits methodology. Assistant City Manager Van Duyn explained the difficulty for South San Francisco is that the absorption of land use without building credits prevents the City from trying to accommodate more housing without getting any credit for it. The legislature was focusing on the issue. He expressed hope the consortium would continue to look at the issue and encourage legislative clean up of the concern. Motion- Councilman Gonzalez/Second Councilwoman Matsumoto: to approve Resolution 106-2010. Unanimously approved by voice vote. REGULAR CITY COUNCIL MEETING DECEMBER 8, 2010 MINUTES - 6 - 14. Discussion and direction to Staff regarding design and construction of the South San Francisco Police Department Evidence Room as it relates to the current renovation of Fire Station 63 and future structural work for the Municipal Services Building. Public Works Director White presented the staff report intended to open up a dialogue between Council and staff as to whether Council would like to proceed with plans for remodeling the Police Evidence Room. The CIP project haci been put on hold because it included an allocation of $100,000 from the General Fund. In the interim, the Fire Department obtained a grant to rebuild the Station below the evidence room. While the FEMA grant cannot be utilized to redo the evidence roam floor to support the new racking system, Council could consider use of other funding, incluciing RDA, police grants and other combinations to permit the work to be done at the same time. Mayor Mullin requested clarification as to what staff was looking for from Council that evening. Public Works Director White advised staff would like a general sense of whether Council wants to go down the path of renovating the Police evidence room. White: gen sense does council want to keep on this path of renovating the police evidence room or not. Councilman Addiego requested information from Chief Massoni as to why renovations were necessary. Chief Massoni advised the Department had been in the building since early 1982. Since that time, standards had drastically changed with advent of DNA and other evidence technologies. For example, evidence in homicide cases was to be maintained for 99 years, whether the case was adjudicated or not. Based on such standards, the present evidence room was bursting at seams. Two holding cells in the building were being used to store evidence. Furthermore, DNA has to be stored in refrigerators. To accommodate all these requirements, a new space was advisable. City Manager Nagel clarified that the present issue was really a discussion about $42,000 for a design study, which could be done as a change order with the architect working on fire house. Staff was requesting direction as to whether Council wanted to go ahead and do the architectural design work as an add alternate to the fire house renovation and/or consider looking at floor renovations. Council determined to do the work of considering architectural design renovations. COMMUNITY FORUM Councilman Gonzalez commended South San Francisco Band Director Latham for a lovely holiday program put on by the high school band.
