RESOLUTION NO. 12-90
CIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION APPROVING PLANS AND
SPECIFICATIONS, AUTHORZING THE WORK
AND CALLING BIDS FOR THE OAK AVENUE
STORM DRAIN
plans and specifications providing for certain improvement
submitted, which plans and specifications are entitled:
DAK AVENUE STORM DRAIN - PROJECT NO. SD-88-01
WHEREAS,i the City Council desires to approve the plans
specificationS, authorize the work and call for sealed proposals;
and
NOW, THE!REFORE, BE IT RESOLVED by the City Council of the City of
South San Francisco, that:
1. Thei plans and specifications identified above are approved and
the work provl, ided for is hereby authorized.
2. Thel Administrative SerYices Officer is hereby directed to
publish a no~ice inviting sealed proposals or bids for the work in
accordance wilth the plans and specifications on file in the Purchasing
Office. NotiCe shall be published at least twice not less than five (5)
days apart in the Enterprise-Journal, a newspaper of general circulation
printed and published in the City of South San Francisco. The first
publication of the notice shall be at least ten (10) days before the date
of opening ofi the bids.
Alli proposals or bids shall be accompanied by a cashier's or
certified cheick payable to the order of the City of South San Francisco
in an amount equal to not less than ten percent (10%) of the bid figure,
or by a bond iin the amount drawn in favor of the City and executed by a
corporate surety. The check shall be forfeited by the bidder, or the bond
shall become !payable to the City in case the lowest responsible bidder
or bidders dePositing the same does not, within the time set forth in the
plans and specifications, enter into a contract with the City. Faithful
performance of the contract shall be guaranteed by an undertaking in the
amount of one hundred percent (100%) of the sum bid, the undertaking
being that ofi a corporate surety satisfactory to the City. The contract
shall be accompanied by a labor and materials bond of a corporate surety,
also in a sum! equal to one hundred percent (100%) of the amount of the
bid for any blid in' an amount not exceeding $5 Million Dollars; and in a
sum as requiried by Civil Code Section 3248 for any bid in excess of $5
~Million Dollars. In case of a forfeiture, as provided for in the
preceding sentence, the defaulting bidder shall be liable to the City for
any additionail expense to which it may reasonably be put in connection
with obtaininl? full and complete performance of the particular work of
improvement wilth which this Notice to Bidders is concerned.
3. Bi!ds will be received by the City of South San Francisco,
California, iat the Purchasing Office, City Hall Annex, 315 Maple Avenue,
South San Francisco, California 94080, at or before the hour of 3:00 P.M.
on Tuesday, !the 27th day of February, 1990.
The bids will be publicly opened, examined and declared at that
time in the! Conference Room, City Nall, 400 Grand Avenue, South San
Francisco, and award will thereafter be made by the City Council of the
City to the ilowest responsible bidder or bidders, subject, however, to
the right of the City Council to reject any and all bids.
I hereDy certify that the foregoing Resolution was regularly
introduced and adopted by the City Council of the City of South San
Francisco at a regular meeting held on the 14th day of Februanv ,
1990, by the following vote:
