CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION INITIATING PROCEEDINGS FOR THE FORMATION OF A
LANDSCAPE AND LIGHTING MAINTENANCE ASSESSMENT DISTRICT
BE IT RESOLVED, by the City Council of the City of South San
Francisco, that
1. The Council hereby proposes the formation of a
maintenance assessment district pursuant to the Landscaping and
Lighting Act of 1972, Part 2 of Division 15 of the California
Streets and Highways Code (commencing with Section 22500
thereof).
2. The maintenance district improvements shall consist of
the installation, maintenance and servicing of the improvements
described in Exhibit "A" attached and by this reference made a
part of this Resolution. Maintenance means the furnishing of
services and materials for the ordinary and usual maintenance,
operation and servicing of said improvements, including repair,
removal or replacement of all or any part of any improvement;
providing for the life, growth, health and beauty of landscaping
including cultivation, irrigation, trimming, spraying,
fertilizing or treating for disease or injury; and the removal of
trimmings, rubbish, debris or other solid waste. Servicing means
the furnishing of electric current or energy for the operation or
lighting of any improvements, and water for the irrigation of any
landscaping or the maintenance of any other improvements.
3. The maintenance assessment district proposed in this
Resoluticn is hereby given the distinctive designation of "City
of South San Francisco Landscape and Lighting Maintenance
Assessment District," which proposed maintenance assessment
district is described in a map entitled "Proposed Boundaries of
City of South San Francisco Landscape and Lighting Maintenance
Assessment District" on file and open to public inspection in the
office of the City Clerk. This map indicates by a boundary line
the extent of the territory included in the proposed maintenance
assessment district.
4. Arthur Wong, City Engineer, is hereby designated as
Engineer for the purposes of the maintenance assessment district
and is hereby ordered to prepare a report in accordance with
Article 4 of Chapter 1 of Part 2 of Division 15 of the California
Streets and Highways Code (commencing with Section 22565
thereof). Upon completion, the Engineer shall file the report
with the City Clerk for submission to this Council.
5. The law firm of Jones Hall Hill & White, A Professional
Law Corporation, San Francisco, California, is appointed and
employed to do and perform all legal services required in the
conduct of these formation proceedings, including the preparation
of all papers not required to be prepared by the Engineer,
examining and approving the engineering documents as to legal
sufficiency and advising the Engineer in the preparation of his
work, advising all officials of this City on all matters relating
thereto when called upon; and that the law firm's compensation
for these services shall be as established in the proceedings.
