HomeMy WebLinkAboutOrd 1317-2002ORDINANCE NO. 1317-2002 AN URGENCY ORDINANCE APPROVING AN AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM AND THE CITY COUNCIL CITY OF SOUTH SAN FRANCISCO WI-IEREAS, the City of South San Francisco has agreed to provide enhancements to the City's retirement system as part of negotiations with members of the South San Francisco Chapter of :he International Association of Firefighters, the Police Association and the Public Safety Mam_gers Unit; and WHEREAS, The California Public Employees' Retirement System staff have prepared the attached Amendment to Contract to implement this enhanced retirement benefit (Section 21362.3 [3% @ 50 Full Formula]; and WHEREAS, pursuant to Government Code sections 36934, this ordinance is an urgency ordinance in that the provision of this benefit relates to the current expenses of the City. Specifically, the effective date of enhanced benefit is November 22, 2002. The provision of this enhanced retirement benefit is a contractual obligation of the agreements referenced hereinabove. "Therefore, :he City must adopt the ordinance at the time it is introduced so that the ordinance is effective at the time the City becomes contractually obligated to provide the benefit." WHEREAS, this ordinance shall apply to all relevant Chapters of the Municipal Code. NOW THEREFORE, the City Council of the City of South San Francisco does ORDAIN as follows: The City Council of the City of South San Francisco does hereby approve Amendment to Contract Between the Board of Administration California Public Employees' Retirement System and the City Council of the City of South San Francisco attached hereto and incorporated herein by reference. BE IT FURTHER RESOLVED, that the Mayor is hereby authorized to execute the Agreement cn behalf of the City. 1. PUBLICATION AND EFFECTIVE DATE This Ordinance shall be published once, with the names of those City Councilmembers voting for or against it, in the San Mateo Times, a newspaper of general circulation in the City of South San F:ancisco, as required by law, and shall become effective thirty (30) days from and after its adoption. 2. SEVERABILITY In the event any section or portion of this ordinance shall be determined invalid or unconstitutional, such section or portion shall be deemed severable and all other sections or portions hereof shall remain in full force and effect. Contributions required of Public Agency and its employees shall be paid by Public Agency to the Retirement System within fifteen days after the end of the period to which said contributions refer or as 'may be prescribed by Board regulation. If more or less than the correct amount of contributions is paid for any period, 'proper adjustment shall be made in connection with subsequent remittances. Adjustments on account of errors in contributions required of any employee may be made by direct payments between the employee and the Board. B.
