CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AUTHORIZING APPROVAL AND EXECUTION
OF A MEMORANDUM OF UNDERSTANDING FOR THE PROVISION
OF HOUSING VOUCHERS UNDER THE RENTAL REHABILITATION
PROGRAM
WHEREAS, the City has been advised by the U.S. Department of Housing and
Urban Development that its application for Rental Rehabilitation Program funds
has been approved in the amount of fifty thousand dollars ($50,000), and;
WHEREAS, the City desires to enter into an agreement with the San Mateo
County Housing Authority for the provision of housing vouchers to be used in
connection with this program;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South
San Francisco that:
1. The Agreement entitled "Memorandum of Understanding between the City
of South San Francisco and the San Mateo County Housing Authority for the
Provision of Housing Vouchers under the Rental Rehabilitation Program" is
hereby approved and a copy of the Agreement is attached as Exhibit "A".
2. The City Manager is hereby authorized to execute the Agreement on
behalf of the City.

adopted by the City Council of the City of South San Francisco at a regular
meeting held on the 8th day of October , 19 86 by the following vote:

MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF SOUTH SAN FRANCISCO
AND
THE SAN MATEO COUNTY HOUSING AUTHORITY
FOR THE PROVISION OF HOUSING VOUCHERS
UNDER THE RENTAL REHABILITATION PROGRAM
UNDER THIS MEMORANDUM, dated October 8, 1986 , by and between
the City of South San Francisco, hereinafter referred to as "CITY" and
the Housing Authority of San Mateo County, a public housing authority,
hereinafter referred to as "PHA", the parties agree to cooperate and
perform the duties herein described for the provision of Housing
ยท Vouchers under the Rental Rehabilitation Program.
1. DUTIES AND RESPONSIBILITIES OF THE CITY
a. The City shall perfOrm all necessary program marketing and
outreach to identify eligible properties and owners willing to
participate in the Rental Rehabilitation Program.
The City shall provide all necessary financial evaluation,
loan packaging and documentation necessary to place rental
rehabilitation loans with eligible property owners.
The City shall provide all necessary technical advice and
preparation to assist the owner in determining the scope of
the rehabilitation work to be performed, including but not
limited to:
- initial inspection
- ordering of technical reports and inspections
- specification writing
- construction bid processing
- contract preparation
- construction progress disbursement
- final inspection, sign-off and closeout
DUTIES AND RESPONSIBILITIES OF THE PHA
a. The PHA agrees to assist the City through existing Housing
Authority records in identifying and selecting those rental
properties which are most likely to meet the local goals of
the Rental Rehabilitation Program.
b. The PHA agrees to review and comment on specifications
provided by the City and to conduct joint initial property
inspections with the City to ensure that Housing Ouality
Standards are addressed.
c. The PHA agrees to interview and screen potential and/or
existing tenants for eligibility requirements of the Rental
Rehab/Housing Voucher Program..
d. The PHA agrees to issue Housing Vouchers to eligible tenants
who wish to participate in the Rental Rehab/Housing Voucher
Program.
e. The PHA agrees to negotiate leases and contracts between the
participating rental property owners and the PHA, and will
conduct reasonable rent standard evaluations.
f. The PHA agrees to pay the affected property owner the
appropriate rental assistance payment(s) as defined by the
Rental Rehab/Housing Voucher Program.
g. The PHA agrees to provide on-going monitoring of program
activities including:
- after-rehab relocation (where necessary)
- annual recertification of tenants
- housing inspections
3. COMPLIANCE ~ITR THE RENTAL REHABILITATION REGULATIONS
The parties agree to carry out the Rental Rehabilitation Program
in a manner which conforms with the provisions of the Regulations,
(24 CFR, Part 5.11). Key among these provisions are:
a. To separate the public subsidies required to finance the
rehabilitation from those provided to tenants; and
b. To require neither direct nor indirect forms of rent control,
unless a pre-existing community-wide rent control ordinance is
in place.
4. COMMITMENT AND USE OF PUBLIC FUNDS
During the program year of 1986-87, the City agrees to enter into
one or more legally binding commitments of public funds with one or
more property owners to write down the cost of financing rehabilitation
of property. The total amount of public funds set aside to be
committed to property owners for the Rental Rehabilitation Program
shall be $50,000. Where other matching public funds are committed from
other Federal Program, including the CDBG Program, they shall be
committed and used by the City and the property owner in accordance
with all requirements applicable to such programs including 24 CFR 570
and applicable HUD Handbooks and Notices for the CDBG Program
(hereafter referred to as "CDBG requirements"), as well as any
additional requirements of the Rental Rehabilitation Program, as set
forth in the approved application and this Memorandum. No waiver of
any CDBG requirement will be made in connection with the rental
Rehabilitation Program unless specifically approved in writing by the
Assistant Secretary of Community Planning and Development, U.S.
Department of Housing and Urban Development.
5. COMMITMENT AND USE OF HOUSING VOUCHER FUNDS
a. HUD has reserved $ (Contract Authority) for tenants
to be assisted by the PHA under the Housing Voucher Program in
connection with.the Rental Rehabilitation Program.
b. The Housing Voucher funds reserved by HUD pursuant to
paragraph (a) above, shall be used by the PHA for issuance of
Housing Vouchers to eligible tenants who occupied properties
undergoing rehabilitation before the .rehabilitation was begun,
or for eligible families on the PHA waiting list willing to
occupy vacant rehabilitated units initially upon completion of
the rehabilitation.
c. The Housing Voucher assistance shall be administered by the
PHA in compliance with all applicable regulations and
requirements.
6. PROPERTIES INCLUDED IN THE RENTAL REHABILITATION PROGRAM:
AGREEMENTS WITH OWNERS
The City may include a property in the Rental Rehabilitation
Program if it requires rehabilitation, is located in one of the Rental
Rehabilitation Program target neighborhoods, is primarily rental
residentia! and will be rehabilitated using financing from the Rental
Rehabilitation Grant in combination with other public or private
rehabilitation financing. The property application will be processed,
underwritten and administered in accordance with the Rental
Rehabilitation Program Regulations. In addition, the City shall
include in any binding legal commitment of CDBG or other public
rehabilitation financing for a property, written agreements by the
property owner, in accordance with the Rental Rehabilitation Program
Regulations.
7. ANTI-DISPLACEMENT~RELOCATION STRATEGY
The City agrees to develop and implement an Anti-Displacement/
Relocation strategy pursuant to the.Rental Rehabilitation Program
Regulations.
IN WITNESS THEREOF, the City and the PHA have executed this
Memorandum.
