CITY OF SOUTH SAN FRANCISCO c 9 LIF0Rt REGULAR MEETING MUNICIPAL SERVICES BUILDING COMMUNITY ROOM 33 ARROYO DRIVE WEDNESDAY, APRIL 27, 2011 CALL TO ORDER: TIME: 7:00 P.M. ROLL CALL: PRESENT: Councilmembers Addiego Gonzalez and Matsumoto, Vice Mayor Garbarino and Mayor Mullin. ABSENT: None. PLEDGE OF ALLEGIANCE: Led by Mayor Mullin. PRESENTATIONS • State of The City Address presented by Mayor Mullin. Mayor Mullin addressed the public with the State of the City Address. He touched on the challenges generally facing municipalities due to the prolonged economic downturn. He then advised of the City's efforts in the areas of sustainability, social equity and fiscal discipline. Sustainability efforts include the City's participation in several training corps and the community based greenhouse gas emissions inventory, the creation of a sustainability division, the installation of solar panels on the annex and a new boiler at the Orange Park Swimming Pool, among other improvements. The new Downtown Parking garage included many green features. Mayor Mullin then addressed the violence that had befallen the City over the past year and relayed the City's efforts to combat the violence and engage and empower citizens. He further explained programs directed at engaging youth in positive, relationship building activities. Finally, he addressed the financial impact of the lingering effects of the "great recession." He relayed several budget saving strategies the City had implemented, including changes to the city's retirement program and medical insurance payment structure. The Mayor closed by pointing out the City's successes, including receipt of the Helen Putnam Award and work on a bicycle master plan. He expressed hope and enthusiasm for sustaining and continuing to improve upon the quality of life in South San Francisco. • CSMFO Meritorious in Operating Budget Fiscal Year 2010 -2011 Award - Presentation made by Budget and Financial Manager, Colleen Tribby and Financial Analyst I, Justin Lovell. Budget Director Tribby advised of the City's receipt of the CSMFO Meritorious in Operating Budget for Fiscal Year 2010 -2011. She advised that Justin Lovell had championed the process resulting in more effective communication of financial results to the public. Financial Analyst Justin Lovell thanked Council for the opportunity to serve the City and noted the Department is constantly striving for ways to increase government transparency. • Streets Alive Presentation. Parks and Recreation Staff Member Laura Armanino invited the public to the Streets Alive event that would take place on May 1 on Grand Avenue. Grand Avenue would be closed to cars for a certain period of time that day and several outdoor exercise and dance activities would be available. Local merchants would be providing specials. • 2011 Farmers Market Presentation. Representatives of Pacific Coast Farmer's Market announced the Farmer's Market would open for the season on May 7th at Orange Memorial Park. New programs this year would include a punch card reward system. Several new merchants would also be in attendance. The Market Staff looked forward to being a part of the community during the upcoming months. • West Nile Virus and Mosquito and Vector Control Awareness Week- Proclamation presented to Mosquito Abatement District Member Ray Honan. Vice Mayor Garbarino presented Mosquito Abatement District Member Ray Honan with a proclamation establishing West Nile Virus and Mosquito and Vector Control Awareness Week. Mr. Honan advised of SMCMAD's mosquito and vector abatement services and invited the public to visit the website www.smcmad.org for additional information on available services. AGENDA REVIEW City Manager Nagel advised the Closed Session Item would not be heard. PUBLIC COMMENTS None. REGULAR CITY COUNCIL MEETING APRIL 27, 2011 MINUTES - 2 - ITEMS FROM COUNCIL • Announcements. • Committee Reports. Councilmembers reported on attendance at community meetings and events, including a WETA Community Advisory Meeting and a HEART Meeting. Announcements were made regarding the upcoming Streets Alive event, the Jazz by the Bay event, the Molloy's Chili Cook -off benefitting the Community Learning Center and the May 3, 2011 Special Election for the open Board of Supervisors Seat. Specific items for further action and /or consideration were set forth as follows: Councilwoman Matsumoto requested that the meeting be adjourned in honor of Irving Sommer. Vice Mayor Garbarino requested that the meeting be adjourned in honor of Angiola Duri. Councilman Gonzalez requested that the new phone tree for City Hall include an option to hear the information in Spanish. CONSENT CALENDAR 1. Motion to approve the minutes of April 13, 2011. 2. Motion to approve expense claims of April 27, 2011. Motion— Councilman Gonzalez /Second— Councilman Addiego: to approve the consent calendar. Unanimously approved by voice vote. LEGISLATIVE BUSINESS 3. Waive reading and introduce an ordinance amending the Historic Preservation Commission ordinance to transfer the role and responsibilities of the Historic Preservation Commission to the Planning Commission. Senior Planner Beaudin presented the staff report recommending that the responsibilities of the Historic Preservation Commission be transferred to the Planning Commission. He advised that the primary goals of the commission had been accomplished and that if issues arose with respect to designated properties, the Planning Commission could effectively handle them while utilizing the South San Francisco Historical Society as a resource. Mayor Mullin requested that commission members be invited before Council to receive recognition for their service. Motion— Vice Mayor Garbarino /Second— Councilman Gonzalez: to waive reading and introduce an ordinance amending the Historic Preservation Commission ordinance to transfer the role and responsibilities of the Historic Preservation Commission to the Planning. Unanimously approved by voice vote. REGULAR CITY COUNCIL MEETING APRIL 27, 2011 MINUTES - 3 - 4. Waive reading and introduce an ordinance approving an amendment to the South San Francisco Municipal Code setting the meeting schedule of the Personnel Board. Human Resources Director Mount presented the staff report requesting that the ordinance be amended from monthly to quarterly as the press of work for the Commission had declined. Motion— Vice Mayor Garbarino /Second— Councilwoman Matsumoto: to waive reading and introduce an ordinance approving an amendment to the South San Francisco Municipal Code setting the meeting schedule of the Personnel Board. Unanimously approved by voice vote. ADMINISTRATIVE BUSINESS 5. Resolution No. 54 confirming a rate increase for the South San Francisco Scavenger Company. Director of Finance Steele presented the staff report recommending that the City Council adopt a resolution confirming the increase in solid waste collection rates as submitted by the Scavenger Company effective July 1, 2011 consistent with the City's Solid Waste Franchise agreement. Councilman Addiego questioned Paul Formosa of the South San Francisco Scavengers as to the ability of residents to save by recycling. Mr. Formosa explained that by recycling, residents could use a smaller density trash can that was available at a lower rate. Mr. Formosa also noted the Company was doing everything it could to limit rate increases. However, costs, including health insurance and others were rising beyond the Company's control. Motion— Councilman Addiego /Second— Vice Mayor Garbarino: to approve Resolution No. 54. Unanimously approved by voice vote. 6. Resolution No. 55 establishing policy goals and the implementation of a voluntary program promoting the reduction of single use bags throughout the City. Assistant to the City Manager Kennedy presented the staff report recommending that the Council adopt a resolution establishing policy goals and a voluntary program promoting the reduction of single use bags throughout the City. The proposed program would call on residents and merchants to voluntarily reduce their consumption of single use bags and use reusable bags instead. It would ask merchants at retail establishments to voluntarily charge a reasonable fee when single use bags are distributed to customers at point of sale. Merchants would then be asked to use the revenue collected from the single use bag fee to promote and encourage using reusable bags. Vice Mayor Garbarino noted that in the past there had been some concern over legal challenges to mandatory programs. REGULAR CITY COUNCIL MEETING APRIL 27, 2011 MINUTES - 4 - Assistant Kennedy explained that several precedent setting Court Cases were presently submitted for decision. The outcomes of these cases could be determinative as to whether mandatory programs could be sustained. In response to a question by Councilman Addiego, City Attorney Mattas added that measures placed on ballots by the public did not require CEQUA analysis of mandatory bans. Councilwoman Matsumoto requested that the voluntary program be reviewed in 6 months with an eye towards making it mandatory depending on the current status of the law. Motion— Councilwoman Matsumoto /Second— Councilman Addiego: to approve Resolution No. 55. Unanimously approved by voice vote. CLOSED SESSION 7. Conference with Labor Negotiators. (Pursuant to Government Code § 54957.6) Agency designated representative: Kathy Mount Employee organizations: AFSCME, Local 829, AFL -CIO Confidential Unit, Teamsters Local 856 International Association of Firefighters, Local 1507 Mid - management Unit International Union of Operating Engineers, Local 39 South San Francisco Police Association Public Safety Managers Executive Management Unit. Item not heard. COMMUNITY FORUM Councilman Gonzalez commented on the occasion of the Midpeninsula Housing Project Groundbreaking at 636 El Camino Real. ADJOURNMENT Being no further business, Mayor Mullin adjourned the meeting at 8:45 p.m. in honor of Angiola Duri and Irving Sommer.
