HomeMy WebLinkAboutReso 3939-1964 RESOLUTION NO. ~93~ RESOLUTION OF INTENTION TO ACQUIRE AND CONSTRUCT IMPROVEMENTS CABOT, CABOT & FORBES INDUSTRIAL PARK, UNIT NO. 1 RESOLVED, by the City Council of the City of South San Francisco, California, that in its opinion the public interest and convenience require and that it is the intention of said Council to order the fol- lowing acquisitions and improvements, to wit: 1. (a) Reclamation of approximately 12 acres of marsh land in the northeast portion of the assessment district by filling to the minimum grade as established by the City Department of Public Works, with earth to be recovered from property of petitioner in or adjacent to the assessment district, including the planting of slopes resulting from the removal of earth for such reclamation, and the protection of the lands from which said earth is removed from erosion and slides. (b) The relocation of power poles along East Grand Avenue from Sperry Avenue to Allerton Avenue. (c) The widening of Sperry Avenue to 80 feet from East Grand Avenue and the opening and extending of Sperry Avenue easterly to the northeasterly boundary of the assessment district. (d) The opening, widening and extending of Allerton Avenue from a centerpoint in East Grand Avenue about 320 feet west of the lands of Swift & Co., thence northeasterly about 574 feet at 80 feet wide and thence northeasterly and northerly to Sperry Avenue at 60 feet wide. (e) The opening, widening and extending of an unnamed cul-de-sac street at 60 feet wide from a point in the west line of Allerton Avenue about 620 feet northeast of East Grand Avenue, thence northwesterly and westerly about 820 feet. (f) The improving of the roadways in subdivisions (c), (d) and (e) above by grading, including the removal of all obstructions and constructing therein of untreated rock base pavement with plant mix surfacing; Portland cement concrete curbs and gutters, sidewalks where required by the City; storm drain pipes, culverts, catch basins, manholes and field inlets and outlets; sanitary sewer mains, laterals and manholes and a lift station complete; electrolier system complete with conduit, cable, pull boxes and luminaires; water mains, hydrant, valves and fittings~ gas mains, valves and fittings; power and tele- phone conduits, cables and appurtenances; fire alarm system complete, street monuments and .signs; retaining walls and head walls; and slope planting for drainage and erosion control. (g) The opening and extending of a railroad drill track right-of-way 20 feet wide from a point in the west line of Allerton Avenue about 1240 feet northeast of East Grand Avenue, thence on a curve to the left and thence to the right to Sperry Avenue at the northwest corner of the assessment district. (h) The opening and extending of a railroad drill track right-of-way 20 feet wide from a point in the west line of Allerton Avenue about 650 feet northeast of East Grand Avenue, thence on a curve to the left to East Grand Avenue at about 520 feet northwest of Allerton Avenue. (i) The opening and extending of a railroad drill track right-of-way 20 feet wide from a point in the west line of ~llerton Avenue about 350 feet northeast of East Grand Avenue, thence on a curve ts the left to East Grand Avenue at about 470 feet northwest of Allerton Avenue. (j) The improving of the rights-of-way described in subdivisions(g), (h) and (i) above by grading and constructing therein railroad drill track, spurs and appurtenances. (k) The making of all acquisitions and the doing of all work auxiliary to any of said improvements and necessary or useful in completing same. 2. That proceedings shall be taken pursuant to appropriate laws for the vesting or transfer of title to and the ownership, maintenance and operation of underground utilities by appropriate public utility companies as determined by this Council. 3. Whenever any public way is herein referred to as running between two public ways, or from or to any public way, the intersec- tions of the public ways referred to are included to the extent that work shall be shown on the plans to be done therein. 4. Said streets and highways are more particularly shown in the records in the office of the County Recorder of San Mateo County, California~ and shall be shown upon the plans herein referred to and to be filed with the City Clerk of said City. 5. Ail of said work and improvements are to be constructed at the places and in the particular locations, of the forms, sizes~ dimensions and materials, and at the lines~ grades and elevatians as shown and delineated upon the plans, profiles and specifications to be made therefor, as hereinafter provided. 6. There is to be excepted from the work herein described any of such work already done to line and grade and marked excepted or shown not to be done on said plans, profiles and specifications. 7. Notice is hereby given of the fact that in many cases said work and improvement will bring the finished work to a grade different from that formerly existing and that to said extent said grades are hereby changed and that said work will be done to said changed grades. 8. Said Council does hereby adopt and establish as the official grades for said work the grades and elevations to be shown upon said plans~ profiles and specifications. Ail such grades and elevations are to be in feet and decimals thereof with reference to the datum plane of the City of South San Francisco. 9. The descriptions of the acquisitions and improvements and the termini of the work contained in this Resolution are general in nature. Ail items of work do not necessarily extend for the full length of the description thereof. The plans and profiles of the work and maps and descriptions as contained in the Engineer's report~ shall be controlling as to the correct and detailed description thereof. 10. Said contemplated acquisitions and improvements, in the opinion of the Council, are of more than local or ordinary public benefit and said Council does hereby make and costs and expenses thereof~ excepting the expense of reclamation, charge- able upon an assessment district, which district said Council declares to be the district benefited thereby, the exterior boundaries of which are more particularly described as follows: Beginning at the Intersection of Roebling Road and East Grand Avenue being 260 feet distant east and on the northerly boundary of East Grand Avenue to the TRUE POINT OF BEGINNING; from said TRUE POINT OF BEGINNING on a tangent which bears S 56° 37' 50" E 1662.0 feet to a point on the southerly boundary; thence from said point on a tangent which bears S 89° 02' 50" E 1115.00 feet; thence N 42° 17' 25" E 12.0 feet; thence S 89° 02~ 50" E to a point on the most southeasterly boundary; thence on a tangent which bears N 0© 04' 35" W 360.00 feet to an angle point; thence S 89° 55~ 15" W 602.16 feet to an angle point; thence N 33© 30' E 330.00 feet to an angle point; thence N 89© 00' 00" E 130.00 feet to an angle point; thence N 36© 45~ E 260.00 feet to an angle point; thence N 27° O0~ 00" W 135.00 feet; thence leaving said tangent on an arc of a curve to the left having a radius of 350.00 feet, an arc length of 175.00 feet and a central angle of 32° 10~; thence from said arc to a tangent which bears N 29° 30~ E 690.00 feet; thence leaving said tangent on an arc of a curve to the right having a radius of 350.00 feet, a central angle of 59° 25~ and an arc length of 353.00 feet~ thence leaving said arc on a tangent which bears N 27° 15' E 358.00 feet to an angle point on the northeasterly boundary~ thence from said angle point on a 'tangent which bears N 7~© 55~ W 45.00 feet; thence leaving said tangent on an arc of a curve to the right having a radius of 350.00 feet, a central angle of 36° 30' and an arc length of 123.00 feet; thence leaving said arc on a tangent which bears N 40° O0~ 00" W 220.00 feet; thence S 50© O0~ 00" W 73.00 feet; thence N 40° O0~ O0'' W 486.00 feet to an angle point on the most northerly boundary; thence leaving said angle point on a tangent which bears S 54° 00' 00" W 869.00 feet; thence leaving said tangent on an arc of a curve to the right having a radius of 570.00 feet, a central angle of 72° 43~ 13" and an arc length of 722.00 feet~ thence to a tangent which bears N 580 05" W 100.00 feet~ thence leaving said tangent on an arc of a curve to the left having a radius of 368.00 feet, a central angle of 70© 26~ 10" and an arc length of 452.00 feet; thence leaving said curve on a tangent which bears S 4,2° 59~ 29" W 520.00 feet; thence N 47© 00? 31" W 350.00 feet to an angle point on the westerly boundary; thence from an angle point on the westerly boundary on a tangent which bears S 42° 59' 29" 134.00 feet; thence S 29° 251W 278.00 feet; thence S 86° 05~ 50" W 60.00 feet to the most westerly angle point; thence from said angle point S 4° 15i E 108.00 feet; thence from said tangent on an arc of a curve to the rmght having a radius of ~50.00 feet, a central angle of 31° O0~ and an arc length of 135.00 feet; thence from said arc on a tangent which bears S 58~ 00~ E 400.00 feet; thence S 33° 24' 33" W 567.00 feet to the TRUE POINT OF BEGINNING. 11. That the contemplated reclamation, in the opinion of the Council, is of more than local or ordinary public benefit, and said Council does hereby make the costs and expenses thereof chargeable upon an assessment district, which district said Council declares to be the district benefited thereby~ the exterior boundaries of which are described as follows: BEGINNING at the most northerly angle point of described assessment district~ on a tangent which bears S 54° 00' W 869.00 feet; thence from said tangent on an arc of a curve to the right having a radius of 570.00 feet, a central angle of 16° 00~ and an arc length of 155.00 feet; thence from said arc on a tangent which bears S 15° 45~ E 357.00 feet~ thence from said tangent on an arc of a curve to the left having a radius of 3520.00 feet, a central angle of 6° 45~ and an arc length of 418.00 feet; thence on a non-tangent curve to the left having a radial bearing of S 16° 00' E~ a radius of 670.00 feet, a central angle of 23° 50~ and an arc length of 278.00 feet; thence leaving said curve on a tangent which bears N 50° 005 E 531.00 feet; thence N 40° 00' W 486.0 feet to the Point of Beginning. 12. Reference is hereby made to a map entitled "Cabot, Cabot & Forbes Industrial Park Unit No. 1, South San Francisco, California, Wilsey, Ham & Blair, San Mateo, California, 212-0601-20-C", for a particular description of the boundaries of each of the districts described in Sections 10 and 11 above, copies of which are on file in the offices of the City Clerk and Public Works Director. 13. It is determined and declared that all public streets and highways within said assessment district in use in the perform- ance of a public function as such shall be omitted from the assess- ment hereafter to be made to cover the costs and expenses of said acquisitions and improvements. 14. There shall be formed a maintenance district of the territory described in Section 11 above of this Resolution, for the maintenance and operation of the reclamation, and grading and slope planting resulting therein, for the proper drainage of the area and for the protection of the streets and other properties within the district from overflow by water, and for the protection of the lands from which earth is removed from erosion and slides. 15. The assessments under Sections l0 and ll above, to the extent that they are on the same lands, may be consolidated and constitute a single assessment. 16. Notice is hereby given that serial bonds to represent the unpaid assessments, and bear interest at the rate of three and three-fourths per cent (3-3/4%) per annura, will be issued hereunder in the manner provided in the Improvement Bond Act ~of 1915, Division l0 of the Streets and Hlghways Code, the last installment of which bonds shall mature not to exceed seven (7) years from the second day of July next succeeding ten (10) months from their date. The pro- visions of Part ll.1 of said Act, providing an alternative procedure for the advance payment of assessments and the calling of bonds, shall apply. 17. Except as herein otherwise provlded for the issuance of bonds, all of said improvements shall be done pursuant to the provisions of the Municipal Improvement Act of 1913. 18. Reference is hereby made to proceedings had pursuant to Division 4 of the Streets and Highways Code on file in the office of the City Clerk. 19. Said proposed acquisitions and improvements are hereby referred to the Engineer of Work, being a competent person employed by sald Council for that purpose; and said Engmneer is hereby directed to make and file with the City Clerk of said City a report in writing presenting the following: (a) Maps and descriptions of the lauds and easements to be acquired; (b) Plans and specifications of the proposed improve- ments to be made pursuant to this Resolution of Intention; (c) Engineer's statement of the ~temized and total estimated costs and expenses of said acquisitions and improvements and of the incidental expenses in connection therewith; (d) Diagram showing the assessment district above re- ferred to, and also the boundaries and d~meusions of the respectiv 6. subdivisions of land within said district as the same existed at the time of the passage of this Resolution of Intention, each of which subdivisions shall be given a separate number upon said diagram; (e) A proposed assessment of the total amount of the costs and expenses of the proposed acquisitions and improvements upon the several subdivisions of land in said district in propor- tion to the estimated benefits to be received by such subdivisions, respectively, from said acquisitions and improvements~ and of the expenses incidental thereto. 20. If any excess shall be realized from the assessment it shall be used, in such amounts as the Council may determine, in accordance with the provisions of law for one or more of the follow- ing purposes: (a) Transfer to the general fund of the City, provided that the amount of any such transfer shall not exceed the lesser of $1,000 or 5% of the total amount expended from the improvement fund; (b) As a credit upon the assessment and any supplemental assessment; or (c) For the maintenance of the improvements.
