HomeMy WebLinkAboutReso 4018-1964RESOLUTION NO. 4018 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO CONSENT TO CANCELLATION OF TAXES ON PROPERTY ACQUIRED FOR PUBLIC USE TO WIT: STREET RIGHT- OF-WAY KNDWN AS "TERMINAL COURT"; AND REQUESTING THE BOARD OF SUPERVISORS TO AUTHORIZE CANCELLATION OF TAXES AND THE DISTRICT ATTORNEY TO CONSENT THERETO BE IT RESOLVED by the City Council of the City of South San Francisco that: WHEREAS, the City of South San Francisco on August 27, 1962, acquired a right-of-way over certain parcels of real property for public purposes to wit: the construction and improvement of a public street called ~'Terminal Court;" which parcels are hereinafter more particularly described, and WHEREAS, the City Council of said City desires to authorize the City Attorney to consent to the cancellation of any uncollected taxes and penalties pursuant to Section 4986.2 of the Revenue and Taxation Code of the State of California, and further requests the Board of Supervisors of the County of San Mateo to authorize cancellation of any uncollected taxes and penalties and the District Attorney of said County to consent thereto; NOW, THEREFORE, IT IS ORDERED that: 1. The City Attorney of the City of South San Fran- cisco is authorized to consent to cancellation of uncollected taxes and penalties on those parcels of real property acquired for public purposes to wit: a right-of-way for the construction and improvement of a street named, "Ter- minal Coumt," which right-of-way consists of three (3) parcels more particularly described as follows: PARCEL I. BEGINNING at a point, said point being the southwesterly corner of the Lands described in the Deed from Produce Development Company., a California corporation, to Lawrence Barrett, as Trustee, dated November 6, 1961, and recorded November 8, 1961, in Book 4089 of Official Records of San Mateo County at page 471 (1300%-U)oL thence along the southerly boundary of said lands North 74°48'11'' East 27g~5~ feet, North 3051'56'' West 30.0 feet and North 74°48'11'' East 5.52 feet to the TRUE POINT OF BEGINNING; thence northeasterly, easterly and southeasterly on a curve to the right, from a point having a radial bearing of South ~5°36'11'' East, said curve having a radius of 50 feet and a central angle of 100 47' 44", an arc length of 87.975 feet to a point having a radial bearing of South 35°12'33'' West, thence South 74°48'11'' West 77.06 feet to the TRUE POINT OF BEGINNING, (Conveyed by Lawrence Barrett, as Trustee, by Grant dated August 1, 1962. PARCEL II. BEGINNING at the southwesterly corner of lands described in the Deed from Produce Development Company, a California corporation, to Lawrence Barrett, as Trustee, dated November 6, 1961, and recorded November 8, 1961, in Book 4089 of Official Records of San Mateo County at page 471 (13002-U);.~tJle~e along the southerly boundary of said lands North 74° 48'11" East 27~:5~?feet, North 3° 51'56" West 30.0 feet and North 74° 48'11" East 360.0 feet to TRUE POINT OF BEGINNING, said true point of beginning being on the westerly boundary of Bayshore Freeway; thence leaving said westerly boundary of Bayshore Freeway South 74° 48' 11" West'16.39 feet; thence northeasterly, northerly and northwesterly on a curve to the left tangent to the preceding course, said curve having a radius ef 20 feet and a central angle of'78° 40' 07", an arc length of 27.46' feet to a point on the westerly boundary of Bayshore Freeway; thence tangent to the preceding curve along said westerly boundary of Bayshore Freeway South 3° 51' 56" East 16.39 feet to the TRUE POINT OF BEGINNING. (Conveyed by Lawrence Barrett, as Trustee, by Grant dated August 1, 1962.) PARCEL III. BEGINNING at a point, said point being the southwest corner of that certain 43.56 acre tract conveyed by Deed from South San Francisco Land and Improvement Company a corporation, to A.D. Schader, dated August 8, 1945, and recorded August 25,1945' in Bock 1202 of Official Records of San Mateo County at page 206 (61788-F);thence along the westerly boundary of said 43.56 acre tract, North 11°39' East 1060.00 feet to the northwest corner of said 43.56 acre tract; thence along the northerly. boundary of said 43.56 acre tract North 74°48'11'' East 287.52 feet to the TRUE POINT OF BEGINNING; thence North 3°51'56'' West 14.82 feet; thence northeasterly on a curve to the right from a point having a radial bearing of South 85°20'11'' East a radius of 50 feet and a central angle of 19° 44' , , an arc distance of 17.22 feet to a point having a radial bearing of South 65o36'11'' East, said point being on the ~ot~therl. y boundary of lands of Barrett; thence along said southerly boundary o[ Ia,ds of Barrett North 74°48'11'' East 3.54[48 feet to a point on the westerly boundary line of Bayshore Freeway; thence along said westerly line of Bayshore Freeway South 3°51'56'' East 30.0 feet; thence South 3°53' East 35.0 feet to the northeasterly corner of Lands of Produce Land and Investment Company; thence along the northerly boundary of said Lands of Produce Land and Investment Company South 74°48'11'' West 124.15 feet to the northwesterly corner of said Lands of Produce Land and Investment Company; thence leaving said northerly boundary of Lands of Produce Land and Investment Company South 74°48'11'' West 140.52 feet; thence southwesterly, westerly and northwesterly on a curve to the right from a point having a radial bearing of North 65°36'11'' West, said curve having a radius of 50 feet and a central angle of 143°13'01", an arc distance of 124~98 feet to the TRUE POINT OF BEGINNING. (Conveyed by Golden Gate Produce Terminal, a California corporation, to the City of South San Francisco by Grant dated July 7, 196%) 2. That this Resolution be filed with the Board of Supervisors of the County of San Mateo and the District Attorney of the County of San Mateo, and be deemed a re- quest to said Board of Supervisors and District Attorney to authorize and consent, respectively, to cancellation of uncollected taxes and penalties on said parcels of real property.
