CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION GRANTING VARIANCES RECOPRv~ENDED
IN PLANNING COMMISSION RESOLUTION NO. 1833
FOR CAESAR-CALLAN HOMES, INC.
BE IT RESOLVED by the City Council of the City of
South San Francisco that:
WHEREAS, the City Council has received the Planning
Commission's written findings of fact, showing that the
qualifications under Section 6.31(a) of the Zoning Ordin-
ance as amended, apply to the land, buildings and use for
which the variance was sought, and that the variance will
be in harmony with the general purpose of the Ordinance
and the recommendations of said Commission, all contained
in Resolution Noo 1833, passed the llth day of .Tmm~,~ry
19 65 and attachments thereto, and
WHEREAS, the City Council duly considered ~ame and
the effect of said variances;
NOW, THEREFORE, IT IS ORDERED that
1. The City Council finds
ao That there are exceptional or extra,ordinary
circumstances or conditions applying to th,.~ land,
building or use referred to in ~he applica~'~ion, which
circumstances or conditions do not apply g~.nerally
to land, buildings or uses in the same dis~:rict.
bo That the granting of the applicati~n is
necessary for the preservation and enjoymel,t of sub-
stantial property rights of the petitioner.
Co That the granting of the application will
not, under the circumstances of the particular case,
materially affect adversely the health or safety
of persons residing or working in the neighborhood
of the property of the applicant, and will not, un-
der the circumstances of the particular case, be
materially detrimental to the public welfare or in-
jurious :o property or improvements in said neighbor-
hood.
d. That by providing common green areas, the
normal yard areas required in the conventional sub-
division are not necessary°
eo That in order to carry out the inten= of
the planned unit concept, the grant of this variance
is essential°
fo That the variance will be in harmony with
the general purpose of this Ordinance.
2. The City Council orders that the variance as re-
commended by the Planning Commission in Resolution No.~,
passed the llthday of January , 19 65, on the
terms and conditions set forth in said Commission's recom-
mendation, be granted.
