CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION GRANTING VARIANCES RECOMMENDED
IN PLANNING COMMISSION RESOLUTION NO. 1835
FOR CAESAR-CALLAN HOMES, INC.
BE IT RESOLVED by the City Council of the City of
Sough San Francisco that:
WHEREAS, the City Council has received the Planning
Commission's written findings of fact, showing that the
qualifications under Section 6.31(a) of the Zoning Ordin-
ance as amended, apply to the land, buildings and use for
which the variance was sought, and that the variance will
be in harmony with the general purpose of the Ordinance
and the recommendations of said Commission, all contained
in Resolution Noo 1835, passed the llthday of J~n,,~ry
19 65 and attachments thereto, and
WHEREAS, the City Council duly considered same and
the effect of said variances;
NOW, THEREFORE, IT IS ORDERED that
1. The City Council finds
ao That there are exceptional or extraordinary
circumstances or conditions applying to the land,
building or use referred to in the application, which
circumstances or conditions do not apply generally
to land, buildings or uses in the same district.
bo That the granting of the application is
necessary for'the preservation and enjoyment of sub-
stantial property rights of the petitioner.
Co That the granting of the application will
not, under the circumstances of the particular case,
materially affect adversely the health or safety
of persons residing or working in the neighborhood
of the property of the applicant, and will not, un-
der the circumstances of the particular ca~e, be
materially detrimental to the public welfa;e or in-
jurious to property or improvements in sai~! neighbor-
hood.
d. That by providing common green ar~as, the
normal yard areas required in the conventi~nal sub-
division are not necessary°
e o That in order to carry out the in~:ent of
the planned unit concept, the grant of thi~; variance
is essential°
fo That the variance will be in harm~,ny with
the general purpose of this Ordinance.
2. The City Council orders that the variar~ce as re-
commended by the Planning Commission in Resolution No..1835,
passed the llth day of January , 19 65., c~.n the
terms and conditions set forth in said Commissicn's recom-
mendation, be granted.
