A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SOUTH SAN FRANCISCO FINDING AND DECLAR-
ING THAT A MAJORITY PROTEST HAS NOT BEEN
MADE TO THE PROPOSED ANNEXATION TO THE
CITY OF SOUTH SAN FRANCISCO OF CERTAIN
UNINHABITED TERRITORY
ANNEXATION OF WESTBOROUGH HOMES LANDS -
1965-2 (PARCEL 2)
RESOLVED, by the City Council of the City of South San
Francisco, California, that
WHEREAS, on April 5, 1965, there was filed with the City
Clerk and presented to this Council a written Petition for and
Consent to Annexation of Uninhabited Territory to the City of
South San Francisco of certain territory designated "Annexation
of Westborough Homes Lands - 1965-2 (Parcel 2)";
WHEREAS, this Council has received evidence showing that
the proposal for the annexation of said territory to the City
of South San Francisco, together with a map and specific legal
description of the boundary of said territory was filed with the
Secretary of the Boundary Commission of the County of San Mateo
and the said Boundary Commission has prepared or caused to be
prepared a report upon the annexation proposal with respect to
the definiteness and certainty of the proposed boundaries and has
done all things required by law;
WHEREAS, said report and the annexation proposal have been
duly considered and approved by the Local Agency Formation Commis-
sion of the County of San Mateo;
WHEREAS, this Council did, on April 5, 1965, at a regular
meeting thereof, duly adopt its Resolution No. ~173 giving notice
of the proposed annexation and which resolution described the
boundary of the territory specifically and designated it by an
appropriate name, to wit: "Annexation of Westborough Homes
Lands - 1965-2 (Parcel 2)", and said resolution contained a notice
declaring that said petition was signed and consent had been filed
by the owners of all of the territory proposed to be annexed, and
further, contained a notice of the time and place this Council
would hear protests against the annexation made by any owner of
property within the City who did not also own property within the
territory to be annexed, said hearing being not more than 30 days
after the passage of the resolution;
WHEREAS, the City Clerk has caused a copy of said resolution
No. 417~ to be published at least four days prior to the date fixed
for hearing, as required by law and Section ~5~10.1 of the Govern-
ment Code; and
WHEREAS, this Council duly met and convened at said time
and place for the purpose of hearing and passing upon all protests
to said proposed annexation and has at the hearing in open public
session duly asked for protests, if any, to the proposed annexa-
tion and has given all persons full opportunity to protest said
annexation and has received evidence relevant to such annexation;
NOW, THEREFORE, IT IS HEREBY FOUND and DETERMINED as follows:
1. That said territory as described in said Petition is
situated immediately adjacent to and touches and is contiguous to
the boundaries of the City of South San Francisco;
R. That said territory is within the boundaries of the
City of Daly City, which has heretofore by its Resolution No. 3?44
entitled "A Resolution Granting Consent to Annexation by the City
of South San Francisco of Territory Within the City of Daly City,
Annexation of Westborough Homes Lands - 1965-~ (Parcel R)", duly
consented to the detachment of said territory pursuant to Section
~530~ of the Government Code;
~. That less than 1R persons who have been registered to
vote within the territory for at least 54 days resided within
the territory at the time of the filing of said Petition for
Annexation with this Council~
4. That said Petition and Consent has been signed and filed
by the owners of all of the land in the territory proposed to be
annexed aa shown on the last equalized assessment roll of the
County of San Mateo in which said territory is situated;
5. That protest to the proposed annexation to the City of
South San Francisco of the territory designated and more fully
described in said Resolution No. 4173 adopted by this Council on
April 5~ 1965, has not been made by public and private owners
entitled to protest thereon pursuant to the Annexation of Unin-
habited Territory Act of 1939.
I hereby certify that the foregoing resolution was regularly intro-
duced and adopted by the City Council of the City of South San Francisco at
a reqular meeting held this 19th day of April ,
1965, by the following vote:
