A RESOLUTION APPOINTING ENGINEER AND ATTORNEYS
STONEGATE RIDGE UNIT NO. 1 AND ADJACENT LANDS
RESOLVED, by the City Council of the City of South San
Francisco, California, that
WHEREAS, this Council has determined to undertake proceed-
ings pursuant to appropriate special assessment and assessment
bond acts for the acquisition and construction of improvements
in said City;
WHEREAS, the public interest and general welfare will be
served by appointing and employing engineers and attorneys for
the preparation and conduct of said proceedings and work in
connection with said improvements;
NOW, THEREFORE, IT IS ORDERED, as follows:
1. That Dan Coleman Associates, San Francisco, California,
be, and is hereby, appointed as Engineer of Work and employed
to do and perform all engineering work necessary in and for said
proceedings, including all preliminary surveying, preparation
of report, plans, profiles, specifications, estimate of costs,
diagram, assessment, setting grade stakes, supervision of work,
preparation, signing and filing the list of unpaid assessments,
and cost certificates, and that compensation therefor be fixed
at a reasonable fee for all of said engineering, to be set forth
in the estimate of cost and approved by the City Council; and
that Daniel P. Coleman, of said Dan Coleman Associates, or his
authorized agent, be, and he is hereby, authorized and directed
to make and sign any certificate or document required to be
made or signed by the Engineer of Work.
2. That the Public Works Director of the City of South
San Francisco is authorized and directed to examine and approve
all engineering documents and to provide the inspection of the
installation of said improvements. The cost of said inspection
shall be assessed as an incidental expense of said proceedings.
3. That the law firm of Wilson, Jones, Morton & Lynch,
San Marco, California, be, and they are hereby, appointed and
employed to do and perform all legal services required in the
conduct of said proceedings~ including the preparation of all
papers not required to be prepared by the Engineer, exclusive
of printing, examining and approving the engineering documents
and advising the Engineer in the preparation of his work,
advising all City officials on all matters relating thereto
when called upon, assisting in the sale of the bonds to be
issued upon the unpaid assessments, and furnishing their legal
opinion on the validity of said proceedings and bonds, and that
their compensation be, and it is hereby, fixed at two per cent
(2%) of the cost of said acquisitions and improvements,
exclusive of incidental expenses, together with reasonable
fees for services in acquiring easements or in eminent domain
or other suits.
4. That all fees provided to be paid in Sections 1 and
3 hereof be assessed as incidental expenses of the proceedings
and be paid from said assessments to be levied and bonds to be
issued, and not otherwise.
I hereby certify that the foregoing resolution was regularly introduced
and adopted by the City Council of the City of South San Francisco at a
meeting held this 16th day of August, 1965 by the following vote:
