HomeMy WebLinkAboutReso 4554-1966RESOLUTION NO. 4554 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ACCEPTING A GRANT DEED FROM CAESAR-CALLAN HOMES, INC., A CALIFORNIA CORPORATION, CONVEYING CERTAIN PARCELS IN WEST PARK 1 AND 2 BE IT RESOLVED by the City Council of the City of South San Francisco that: 1. The City of South San Francisco, a municipal cor- poration, does hereby accept the Grant Deed from Caesar- Callan Homes, Inc., a California corporation, executed the 3Oth day of September, 1966, by Caesar-Callan Homes, Inc., a California corporation, Joseph C. Caesar, Vice President, and Thomas J. Callan, Jr., Secretary, whereby conveyance of the parcels set forth in Exhibit "A" attached hereto and made a part hereof, was made to the City of South San Fran- cisco, a municipal corporation, and which parcels are to be maintained by the West Park Parks and Maintenance District as common green and open landscaped areas for the Planned Community Districts known as West Park 1 and 2. 2. Said Grant Deed be forwarded to the Title Insur- ance and Trust Company together with a certified copy of this Resolution with the following instructions: (a) to record said Grant Deed and the Resolution accepting same; (b) to obtain and record the releases and re- conveyances provided for in the Deed of Trust set forth and described in Exception 7 of the Report of Title (amended) No.37Ol18, dated September 29, 1966, issued by Title Insurance and Trust Company to Caesar-Callan Homes, Inc., signed by Alex F. Arcady, Title Officer; (c) to issue, at Grantor's expense, a policy of title insurance to the City of South San Francisco for said parcels guaranteeing title vested in the City of South San Francisco free and clear of the Deeds of Trust set forth in Exception 7 and any other Deed of Trust then appearing of record; (d) upon recordation of said releases and re- conveyances and issuance of said policy of title in- surance, deliver to Caesar-Callan Homes, Inc., the re- lease of Contract Bond No.97-74-88, which Bond was issued by Glens Falls Insurance Company of Glens Falls, New York, on the 8th day of September, 1964, and exe- cuted by Caesar-Callan Homes, Inc., d.b.a. Westborough Homes, as principal, and Glens Falls Insurance Company. 3. Arthur A. Rodondi, City Clerk, shall execute and deliver to Title Insurance and Trust Company a release of Contract Bond No.97-74-88 issued by Glens Falls Insurance Company, said release to be deposited in escrow for delivery to Caesar-Callan Homes, Inc. upon completion of the items previously set forth in this Resolution. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 3rd day of October , 1966, by the following vote: AYES, COUNCILMEN NOES, " ABSENT, " Frank J.
