A RESOLUTION DESCRIBING PROPOSED MODIFICATION IN
THE BOUNDARIES OF ASSESSMENT DISTRICT AND OF
INTENTION TO ORDER A MODIFICATION IN SAID
BOUNDARIES
CABOT, CABOT & FORBES INDUSTRIAL PARK
UNIT NO. 2
RESOLVED, by the City Council of the City of South San
Francisco, California, that
WHEREAS, on January 17, 1966, this Council adopted
its Resolution NOo 4356, A Resolution Describing Proposed
Boundaries of Assessment District, Directing Filing of Map
and Directing Recordation of Notice of Assessment, Cabot,
Cabot & Forbes Industrial Park Unit NOo 2, wherein the
boundaries of the proposed assessment district to be formed
pursuant to Resolution of Intention No. 4236, adopted by
said Council on June 28, 1965, were described by reference
to a map on file in the office of the City Clerk;
WHEREAS, said map, as approved by said Council, was
filed in the office of the County Recorder of San Mateo
County within fifteen (15) days after adoption of said
resolution, as required by law;
WHEREAS, this Council has received a petition from the
owners of property within the assessment district formed
pursuant to said Resolution of Intention, for the exclusion
of a portion of the assessment district formed in said
proceedings;
WHEREAS, it appears that the exclusion of such portion
of such lands will not increase the cost of any assessment
by reason thereof or substantially affect the distribution
of benefits from the work; and
WHEREAS, the Engineer of Work has prepared a revised
map of the assessment district with said portion excluded;
NOW, THEREFORE, IT IS ORDERED, as follows:
lo The proposed modification in the boundaries of
the assessment district is hereby described by reference
to the map of the assessment district, revised to exclude
the portion of the assessment district designated Cabot,
Cabot & Forbes Industrial Park Unit No.
2o The City Clerk is hereby directed to file said
revised map with the County Recorder of the County of
San Mateo forthwith°
3o This Council hereby expresses its intention to
order the following modifications at its first meeting
held at least ten days after the filing of Said revised
map in the office of the County Recorder:
a) To modify the boundaries of the assessment
district by excluding said lands°
b) To modify the estimate of cost to reflect
the fact that one-half of the total estimated cost of
$3,500,000, or $1,750,000, is to be paid from Cabot, Cabot
& Forbes Industrial Park Unit NOo 2, and the remainder one-
half, or $1,750,000, is to be paid from Cabot, Cabot &
Forbes Industrial Park Unit No°
c) To reduce the total assessment to $1,750,000.
d) To order that said changes shall be made in
the EngineerUs Report by filing a new modified report in
the office of the City Clerk°
e) To amend the ResolUtion of Intention and the
proceedings and the estimate of cost to provide that the
right is reserved to make contributions to, and receive
contributions from the assessment proceedings to be under-
taken for Cabot, Cabot & Forbes Industrial Park Unit No.
to the end that all of the costs of the acquisitions and
improvements described in each of said proceedings shall be
divided and assessed equally therein°
f) That the adoption of this Resolution and the
subsequent resolution ordering said changes, is without
prejudice to the right of the Council to initiate and con-
summate proceedings forthwith for the formation of a new
assessment district comprised of the area excluded from the
present district and to be formed for the purpose of financ-
ing one-half of the cost of the acquisition and construction
of the work described in said proceedings, together with
expenses incidental thereto, pursuant to the original peti-
tion and the petition referred to in this Resolution, and
shall not affect in any way the boundaries and existence of
the Cabot, Cabot & Forbes Industrial Park Unit NOo 2 Mainte-
nance District heretofore formed and now existing pursuant
to said Resolution of Intention, nor any guarantee hereto-
fore given by the owners to the City°
I hereby certify that the foregoing resolution was regularly intro-
duced and adopted by the City Council of the City of South San Francisco
at a regular meeting held this 16th day of January, 1967 by the following
vote:
