CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
RESOLUTION AWARDING THE CONSTRUCTION
CONTRACT TO ROBERT A. BOTHMAN, INC. FOR THE
WESTBOROUGH PARK IMPROVEMENT PROJECT IN AN
AMOUNT NOT TO EXCEED $1,988,500 AND ACCEPTING A
GRANT IN THE AMOUNT OF $9,000 AND A DONATION OF
$59,000 AND APPROPRIATING ADDITIONAL FUNDS TO
THE PROJECT AND AMENDING THE 2011 -2012 CAPITAL
IMPROVEMENT BUDGET
WHEREAS, staff issued a Notice Inviting Bids for the Westborough Park Improvement
Project and on August 16, 2011, received three (3) valid bids in response; and
WHEREAS, Robert A. Bothman, Inc. of San Jose, California, was the lowest responsible
bidder; and
WHEREAS, staff recommends awarding the construction contract to Robert A. Bothman
of San Jose, California, in the amount of $1,988,500; and
WHEREAS, the Project is included in the City of South San Francisco's 2011 -2012
Capital Improvement Program ( "CIP "); and
WHEREAS, additional funds from Park -In -Lieu Fees — Zone 1, Westborough Park Pool
Funds, including a $59,000 donation, Proposition 12 - Residual Park Bond Funds, ABAG Risk
Management and Playground Recycled Surfacing Grants and a Loan from Park -In -Lieu Fees —
Zone 2 are required to cover the Project cost above the amount originally budgeted.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of South San
Francisco that the City Council hereby awards the construction contract for the Westborough
Park Improvement Project to Robert A. Bothman, Inc. of San Jose, California, in an amount not
to exceed $1,988,500, conditioned on Robert A. Bothman, Inc.'s timely execution of the Project
contract and submission of all required documents, including but not limited to, executed bonds,
certificates of insurance, and endorsements, in accordance with the Project documents.
BE IT FURTHER RESOLVED that the City Council of the City of South San Francisco
accepts a grant from the Department of Resources Recycling and Recovery in the amount o
$9,000 and a donation from the Westborough Park Neighbors of $59,000 and authorizes th-
Finance Department to establish the Westborough Park Improvement Project Budget (" Project
Budget ") consistent with the information contained in the staff report, with funding appropriate'
as follows:
Construction Budget already established $1,700,500.00
Westborough Park Pool Funds (includes approx. $59k donations) $ 304,000.00
Park -In -Lieu Fees — Zone 1 $ 209,300.00
Proposition 12 — Residual Park Bond Funds $ 35,900.00
ABAG Risk Management Grant $ 50,000.00
Playground Recycled Surfacing Grant $ 9,000.00
Loan from Park -In -Lieu — Zone 2 $ 160,000.00
BE IT FURTHER RESOLVED that the City Council of the City of South San Francisco
authorizes the Finance Director to adjust the loan amount from Park -In -Lieu Fees — Zone 2
according to the final interest earnings that the other funding sources realized as of 8/31/11.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute the
documents on behalf of the City Council upon timely submission by Robert A. Bothman, Inc.'s
signed contract and all other documents, subject to approval by the City Attorney.

September 2011 by the following vote:

Vice Mayor Richard A. Garbarino and Mayor Kevin Mullin
