HomeMy WebLinkAboutReso 4752-1967RESOLUTION NO. 4752 OITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION REGARDING THE ISSUANCE OF A GRADING PERNIT - WESTBOROUGH UNIT NO. 4 WHEREAS, Caesar Callan Homes, Inc., a'California corporation, and Ptombo Construction Co., hereinafter designated "Applicants," desire to grade a portion of a parcel designated as Westborough Unit No. 4, and haul, or cause to be hauled, from said parcel to San Francisco International Airport surplus material from said site, and; WHEREAS, said grading will affect the proposed right of way for Gellert Boulevard Extension southeasterly from the intersection at West- borough Boulevard to the intersection at Sunipero Serra Boulevard; NOW, THEREFORE, it is ordered thais 1. Authorization to Issue Grading Permits The City Council hereby authorizes the City Clerk to issue a Grading Permit to Caesar Callan Homes, Inc., and Piombo Construction Co., (hereinafter designated "Applicant,s) when the Council determines and orders included in said permit the terms and conditions necessary for the health, safety, peace, morals, comfort and general welfare of the City of South San Francisco, which terms and conditions are to be determined in accordance with the provisions hereinafter set forth or alternate procedures approved by the Council. Should the Council not so determine and order terms and conditions as hereinabove provided, then~his authorization may be revoked. 2. Designation of Site and Plans~ The City Council hereby designates as the grading site that portion of Westborough Unit No. 4 shown on the plans entitled, "Borrow Area A, 0.9 Million Yard Borrow Area, Westborough Unit No. 4, prepared by Theodore V. Tronoff, Survey No. 5750, Drawing No. WB4-G-5 dated October 18, 1967." 3. Proposed Gellert Boulevard Riqht of Ways City may require an agreement to dedicate the right of way for Gellert Boulevard from the intersection at Westborough Boulevard to the inter- section at Junipero Serra Boulevard, the filing of plans and specifications and the construction and installation of improvements, security for the performance of which shall be determined by the Council. 4. Operating Plan for Grading and Removal of Surplus Material= Applicant shall file an operating plan'with the City Manager for the grading and removal of material from said designated site in accord- ance with said #plans~ which, when approved by the City Manager and the department heads, shall be submitted to the City Council for consideration and determination by the Council of the terms and conditions of a grading and hauling permit for said area. The operation plan with~approval and recommendations from the City Manager and department heads shall include, but not be limited to, the following factors~ The type and number of trucks to be used in the proposed ae operation. b. The number of trucks to be dispatched from the site per unit of time and number of trucks scheduled to use truck routes in the City of South San Francisco per unit of time. c. The weight of the loaded vehicle. d. Fees~ charges, and/or surety bonds necessary to compensate and/or secure City for street repairs. e. Designated haul routes through this City and other areas, together with permits to use truck routes in other areas. f. Dust control procedures at the site and in the use and operation of the trucks while transporting the fill material from the site and returning to the site. g. Indemnity provisions for operations at the site and from the site to the point of delivery. h. Plans and criteria for the grading of the designated site and removal of surplus material therefrom which shall include, but not be limited to, the recon~endattons set forth in the Inter-Office Memorandum to the City Council from the Director of Public Works dated October 24, 1967, Subjects #Grading and Hauling Permits - Gellert Boulevard Extension." i. Any other provisions necessary for the health, safety, peace, morals, comfort and general welfare of the City of South San Francisco. 5. Determination of Terms and Conditions= The City Council after reviewing the operating plan as approved by the City ~anager and department heads, may determine the terms and condi- tions of the Grading Permit and order same included in said permit. The Council shall include in said terms and conditions provisions authorizing the City ~anager to reasonably adjust the standards and/or conditions related to the type and number of trucks to be used in the proposed operation, the number of trucks to be dispatched from the site per unit of time and the number of trucks scheduled to use truck routes in the City of South San Francisco per unit of time, the weight of the loaded vehicle, the haul routes through the City and dust control procedures, necessary for the health, safety, peace, morals, comfort and general welfare of the City of South San Francisco. 6. Park Site Encumbrances and Grading= Should the Council determine the terms and conditions of the Grading Permit and order same included in said permit, said permit shall not stand granted until= a. Park Site Encumbrances= In accordance with the terms of the Agreement entitled, "Agreement - Securing Performance of Agreement of October 24, 1963, Re~ Park - Recreation, Fire Station and Public Library Sites in Westborough," entered into between Caesar Callan Homes, Inc., et al, and the City of South San Francisco on the 5th day of Sune, 1967 (recorded in the office of the County Recorder, Volume 5322, pages 132 through 200), applicants shall clear the liens and encumbrances from the parcel therein designated as Parcel I - Park Recreation Site and designated as Exhibit B to said agreement, and deliver to City prior to the issuance of a Grading Permit as in this Resolution pro- vided, a policy of title insurance, evidencing marketable title to said parcel in the City of South San Francisco, as set forth in said agreement. b. Park Site Grading= In accordance with the terms of the Agreement set forth in Paragraph "a' above, and particularly Paragraph 6 of said agreement, applicants shall complete the park site grading as in said Paragraph 6 provided, except that should the landscape plans for said park site not be approved and filed prior to the commencement of said grading operations, then provisions shall be made for the completion of said park site grading during the course of the grading operations, time for commencement and completion to be desig- nated by City. ! hereby certify that the foregoing Resolution was regularly intro- duced and adopted by the City Council of the City of South San Francisco adjourned at a r~g,l~r meeting held on the 2~t.hday of October , 19~.7 , by the following votes AYES, COIJNClIJ~EN NOES, ABSENT, Patrick E.
