HomeMy WebLinkAboutReso 116-2011 RESOLUTION NO. 116 -2011 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA RESOLUTION APPROVING AN AGREEMENT WITH MIRACLE PLAYSYSTEMS, INC. OF ALAMO, CALIFORNIA, FOR THE PURCHASE AND INSTALLATION OF PLAYGROUND EQUIPMENT IN AN AMOUNT NOT TO EXCEED $307,743 WHEREAS, staff recommends that the City Council adopt a resolution approving an agreement with Miracle Playsystems, Inc. of Alamo, California, for the purchase and installation of new playground equipment for Orange Memorial Park, between the Pool and the Joseph A. Fernekes Building; and WHEREAS, the project will involve installation of new ADA compliant playground equipment; and WHEREAS, Section 4.04.040 of the South San Francisco Municipal Code authorizes the City to take advantage of valid contract terms that have been negotiated by another governmental agency, where that agency had used a quote or bid process substantially conforming with SSFMC Chapter 4.04 and State law; and WHEREAS, The Houston - Galveston Area Council (H -GAC) is a regional council of governments and governed by a board comprised of 35 elected officials from the 13 county region. The H -GAC Board awards all contracts, which can then be made available to local governments nationwide thru HGACBuy; and WHEREAS, staff has verified that the proposed agreement with Miracle Playsystems, Inc. has properly utilized the HGACBuy bidding process; and WHEREAS, staff has also verified that several California Cities have utilized the current HGAC bidding process and prices for the purchase of playground equipment with Miracle Playsystems, Inc.; and WHEREAS, the proposed agreement with Miracle Playsystems, Inc. will use valid contract terms established through the HGACBuy process; and WHEREAS, funding is included in the 2011/12 CIP Budget (510- 99999- pk1207) in the amount of $400,000 for the Orange Memorial Park Playground Replacement Project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the City Council hereby awards an agreement to Miracle Playsystems, Inc. of Alamo, California, in the amount of $307,743 for purchase and installation of playground equipment. BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute the agreement on behalf of the City of South San Francisco, upon timely submission by Miracle Playsystems Inc. of the signed agreement, and all other required documents, subject to approval as to form by the City Attorney. * * I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 28 day of September 2011 by the following vote: AYES: Councilmembers Mark Addiego, Pedro Gonzalez, and Karyl Matsumoto, Vice Mayor Richard A.
