HomeMy WebLinkAboutReso 5040-1969RESOLUTION NO. 5040 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVING RELOCATION OF EXISTING SPUR TRACK ACROSS EAST GRAND AVENUE- 'VICINITY OF LITTLEFIELD AVENUE. WHEREAS, Southern Pacific Company, a corporation, has applied for permits to construct and operate a drill track and spur track in the locations hereinafter designated, and WHEREAS, the City of South San Francisco desires to issue said permits on the conditions hereinafter stated; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Francisco that the Southern Pacific Company, a corporation, be, and it is hereby, permitted to construct and operate a drill track and spur track as here- inafter designated upon the following conditions: A. Conditions: 1. That the trackage will be constructed as nearly as possible level with the street grading. 2. That the permittee, Southern Pacific Company, a corporation, shall maintain and keep in repair the trackage and street crossings by said trackage extending two (2) feet each side of said trackage. 3, That in the event said trackage is abandoned and no longer required for service, permittee shall remove the trackage, or cause it to be removed, at its own expense, and at no cost to the City of South San Francisco, and shall restore the surface of the street and the bed in accordance with specifications of the City of South San Francisco. 4. That permittee, Southern Pacific Company, a corporation, shall hold City harmless from any claims, suits, or demands arising out of personal injury or property damage caused by construction, operation, maintenance, repair, or - 1 - condition of said trackage and area contained between lines two (2) feet on each side of said trackage, and further shall defend any and all suits, claims, or demands brought because of personal injury or property damage. 5. That permittee, Southern Pacific Company, a corporation, shall install, maintain and operate sufficient safety signals, or other precautions, required to keep said crossings safe for the public to travel over and across; and should the original installation of crossing signals prove inadequate because of increased traffic or because of other matters, permittee shall modify or install safety precautions or signals adequate to meet said increase in traffic or other matters. That the original installation shall be P.~.C. Standard No. 3 Signal 6. This trackage shall be used as industrial track- age and not as a main line or any portion thereof. 7. The location of the spur track is described as follows: Beginning at a point in the prolongation of the south- westerly line of East Grand Avenue, distant 7.50 feet, more or less, northwesterly from the point of intersection of said line with the prolongation of the northwesterly line of Littlefield Avenue, thence southeasterly across East Grand Avenue, distant 101.02 feet, more or less, to a point in the northeasterly line of East Grand Avenue, distant 6.80 feet more or lesssoutheasterly from the point of intersection of said line with the prolongation of the northwesterly line of Littlefield Avenue. Reference is hereby made to a map entitled: Southern Pacific Company, Pacific Lines, South San Francisco, Proposed Trackage to Serve California Tire Company, Southern Pacific Company, Western Division Drawing S-3910, Sheet 1, dated December 30, 1968. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular - 2 - NOES , ABSENT, meeting held on the 17th day of February , 19 69 by the following vote' AYES, COUNCILMEN Frank 3.
