HomeMy WebLinkAboutReso 5049-1969RESOLUTION NO. 5049 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ESTABLISHING A PUBLIC UTILITY EASEMENT AND AUTHORIZING GRANT OF RIGHT OF USE TO ~CALIFORNIA WATER' ~S'ERVI~CE 'COMPANY.~ BE IT RESOLVED by the City Council of the City of South San Francisco that: WHEREAS, the City Council by Resolution No. 4835, passed the 6th day of May, 1968, entitled "A Resolution Establishing Public Service Easement (Siemer/Repair Gas)~'', approved the establishment of a public utility easement for the extension of public utility services to Siemer Ship Repair, and said Council desires to hereby establish said public utility ease- ment and authorize grants for use thereof as hereinafter set forth; NOW, THEREFORE, IT IS ORDERED THAT: 1. A public utility easement is hereby established over, across and through the parcel of property which is under the ownership and control of the City of South San Francisco, a municipal corporation, and is more particularly described as follows: Ail that certain real property situate in the City of South San Francisco, County of San Mateo, State of California, and more particularly described as follows: BEGINNING at the most southerly corner of that certain parcel of land described as Parcel B in the Deed from South San Francisco Land and Improvement Company, a corporation, to the City of South San Francisco, a municipal corporation, dated January 27, 1948 and recorded February 19, 1948 in Volume 1462 of Official Records of the County of San Mateo, California, at page 2 (15916-H); thence from said Point of Beginning along the westerly line of said Parcel B, N 0°00'55'' W (Called North in aforesaid deed) 125.97 feet; thence leaving said westerly line, N 21°04'05'' E 139.65 feet; thence N 31°12'09'' W 25.41 feet to a point in the dividing line between Tide Lots 7 and 26 produced westerly, said point being along last said westerly production N 89°59'05'' E 37.08 feet from the north- westerly corner of the hereinabove mentioned Parcel B; - 1 - I "Ii i ' thence continuing along said westerly production of the line dividing Tide Lots 7 and 26, N 89059'05'' E 75.12 feet; thence leaving said line, S 21004'05'' W 172.91 feet; thence S 0000'55'' E 83.67 feet; thence southwesterly, curving to the left from a tangent which bears S 64050'46'' W, with a radius of 205.00 feet and a central angle of 16049'46'' an arc distance of 60.21 feet; thence'N0°00'55'' W 0.17 feet to the Point of Beginning. 2. A ten foot (10') non-exclusive easement located within the boundaries of the parcel described in Paragraph 1 above is hereby granted to the California Water Service Company for the purpose of constructing, laying, maintaining, operating, using, altering, repairing, inspecting and relocating therein and thereupon and/or removing therefrom main, mains, pipe line or pipe lines with any and all connections necessary or convenient thereto, for the transportation, distribution and/or supply of water in connection with its business as a public utility water company for all purposes in connection therewith, provided that all of said pipes', pipe lines, connections and fixtures shall be below grade except as permitted by the Director of Public Works. Said California Water Service Company shall file an as-built plan with the City Clerk and Director of Public Works and the pipe line installation as thereon shown shall establish the centerline of the ten foot (10') non-exclusive easement hereby granted to California Water Service Company. 3. A non-exclusive easement is hereby granted to Pacific Gas and Electric Company, a California corporation, providing the right to excavate for, install, replace, maintain and use for conveying gas an underground main or pipe line, and suitable service pipes and connections, together with a right of way within the hereinafter described strip of land and the right of ingress thereto and egress therefrom over and across those lands situated in the City of South San Francisco, County of San Mateo, State of California, which are described as follows, to wit: - 2 - A strip of land of the uniform width of $ feet, extend- ing southerly from the northerly boundary line of Section 23, Township 3 South, Range 5 West, Mount Diablo Base and Meridian;and lying equally on each side of a line which begins at a point in said northerly boundary line of Section 23 from which the intersection of said northerly boundary line with the northeasterly boundary line of that certain parcel of land described and designated Parcel B in the deed from South San Francisco Land and Improvement Company to first party, dated January 27, 1948, and recorded in the office of the County Recorder of said County of San Mateo in Book 1462 of Official Records at page 2 bears West 20.92 feet distant, and runs thence South 9052'43'' West 291.4 feet; thence South 39052'43'' West 45 feet. The route of said main or pipe line across said lands shall be as follows: Under, across, along and within the above- described strip of land. The Grantee shall file with the City Clerk and Director of Public Works an as-built plan of said installations. The installations within the easement by the Grantee shall be below grade except as permitted by the Director of Public Works. 4. The Mayor of the City of South San Francisco is hereby authorized to execute said grants on behalf of the City and City Clerk attest his signature thereto. 5. The City Council intends to establish a street right of way over, across and through said parcels and upon establish- ing said street right of way said public utility easements shall merge and become part of the easement for street and highway purposes. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the regular ' ~ meeting , 19 69 , by the City of South San Francisco at a held on the 17th day of February following vote: AYES, COUNCILMEN NOES, " ABSENT, " Frank J. Bertucelli, Patrick E. Ahern, F. Frank Mammini, Andrew Rocca, and Warren Steinkamp. None. None. ATTEST'
