HomeMy WebLinkAboutReso 5259-1970RESOLUTION NO. 5~59 A RESOLUTION ORDERING MODIFICATION IN BOUNDARIES OF ASSESSMENT DISTRICT, AND ORDERING WITHDRAWAL OF TERRITORY FROM A.ND ANNEXATION OF TERRITORY TO CABOT, CABOT ~ F)RBES INDUSTRIAL PARK UNIT NO. 2 MAINTENANCE DISTRICT CABOT, CABOT & FORBES INDUSTRIAL PARK UNIT NO. 2 BOND SERIES 68 - MODIFICATION NO. 3 RESOLVED, by the City Council of the City of South San Francisco, California, that WHEREAS, this Council has heretofore expressed its · intention, in Resolution No. 52~4 adopted February 2, 1970, to order a modification in the boundaries of the assessment district formed pursuant to Resolution of Intention No. 4236, adopted June 28, 1963; WHEREAS, all of the conditions and events set forth in said Resolution No. 5244 as being prerequisite to the order- ing of said modification have been fulfilled and have hap- pened in due time and form required by law, and this Council has acquired Jurisdiction ~o order said modification; WHEREAS, this Council, in said Resolution No. 52~, has expressed its intention to order a withdrawal of ter- ritory from and annexation of territory to Cabot, Cabot ~ Forbes Industrial Park Unio No. 2 Maintenance District, duly formed by Resolution No. 4421, A Resolution Ordering Formation of Maintenance D£strict, adopted March 21, 1966; WHEREAS, notice of the withdrawal of territory from and the annexation of territory to said Maintenance District has been duly given in the time, form and manner required by law, as evidenced by the affidavits on file with the City Clerk of this City, and this Council has Jurisdiction to order said withdrawal from and~annexation to said Maintenance District; NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED and ORDERED, as follows: 1. That the boundaries of the assessment district formed pursuant to said Resolution of Intention are hereby modified to conform to the map referred to in said Resolution No. 5244, entitled "Proposed Modified Bo~mdaries of Cabot, Cabot ~ Forbes Industrial Park Unit No. 2 Assessment District, Bond Series 68, Modification No 3" dated June, 1969, on file in the office of the County Recorder of the County of San Mateo o 2. That no objections to the withdrawal of said territory from the Maintenance District, nor to the continuance of the remaining territory as a maintenance district, nor to the in- clusion of said territory with'_n said Maintenance District have been made, either orally or in writing. 3. That the portion of ~he District sought to be withdrawn will not be benefited by remaining within said Maintenance Dis- trict, and that the remaining portion not sought to be withdrawn will be benefited by continuing as a maintenance district. 4. That all of the territory proposed to be annexed to said Maintenance District will be benefited by annexing to said District. 5. That the territory proposed to be withdrawn is hereby ordered withdrawn from said District; that the boundaries of the District are hereby altered to include the territory pro- posed to be annexed; and that ~he remaining territory of said District after such withdrawal and including the area annexed shall continue as a maintenance district. 6. That the City Clerk shall file a statement of change of boundaries of said Maintenance District with the State Board of Equalization and the County Assessor of San Mateo County, as required by Section 54900 e~ seq. of the Government Code. 2 I hereby certify that the foregoing resolution was regularly intro- duced and adopted hy the City Council of the City of South San Francisco at a regular meeting held this 2nd day of March, 1970, hy the following vote= AYES, COUNCILMEN Frank J. 3ertucelli, Patrick E.
