HomeMy WebLinkAboutReso 5317-1970 RESOLUTION NO. 5317 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING ISSUANCE OF A PERMIT TO CONSTRUCT AND OPERATE A SPUR TRACK ACROSS KAUFFMANN COURT IN CABOT, CABOT & FORBES INDUSTRIAL PARK UNIT NO. 2. BE IT RESOLVED by the City Council of the City of South San Francisco that.~.a spur track permit is hereby granted to Southern Pacific Company, a corporation, to construct and operate a spur track across Kauffmann Court in Cabot, Cabot & Forbes Industrial Park Unit No. 2, said trackage to be within railroad easement of record with centerline of said trackage being more particularly described as follows: Beginning a point on the southwesterly line of Kauffmann Court, distant 409.62 feet, more or less, from the inter- section of the prolongation of said line with the center- line of Forbes Boulevard. thence southeasterly a distance of 60.38 feet, more or less, to a point on the north- easterly line of Kauffmar.n Court, distant 418.82 feet, more or less, from the ir.tersection of the prolongation of said line with the cer.terline of Forbes Boulevard, as shown on prints of Southern Pacific Transportation Company, Western Division, Drawing S-4067, Sheet 1, dated December 19, 1969 (Revised March 12, 197[, to correct profile between Stations 21 + 65 and 37 + 15) entitled "Proposed Drill Track Extension for Cabot, Cabot g Forbes," delineating by red line the centerline of proposed ~rack, copies of which are on file in the office of the City CLerk and Director of Public Works, said spur track permit being issued on the following terms and conditions: 1. The track and appurtenant works shall be constructed level or as near as possible thereto with the improved street level of Kauffmann Court. 2. Permittee shall construct, install and maintain the track and appurtenant work so as not to damage the street improve- ments, at no cost or expense to City. 3. In the event said track and appurtenant works are abandoned and no longer required for service, Permittee shall remove the tracks and said appurtenant works, or cause same to be removed, le at Permittee's expense and a~ no cost or expense to City and shall restore the surface of the street and the bed in accordance with said street specifications or alternate specifications estab- lished by the City of South San Francisco. 4. Permittee shall hold City harmless from any claims, suits or demands arising out of personal injury or property damage caused by the construction, operation, maintenance, repair or condition of said track and appurtenant works and any defects in the street right-of-way caused thereby and shall further defend any and all suits, claims or demands asserted because of property damage and personal injury, including death. 5. Permittee, as required by the Public Utilities Commission, shall install, maintain and cperate sufficient safety signals or o~her precautions required to maintain public safety at said crossing and should the original installation of said safety signals or other precautions prove inadequate because of increased traffic or other matters, Permittee shall install new or additional safety precautions or signals required by reason of said increased traffic or other conditions. 6. The tracks and appurtenant works shall be used for drill or spur track purposes only and not as a main line or any portion thereof. 7. Permittee shall relocate said tracks and appurtenances at no cost or expense to City should same be necessary by reason of City's street improvement or repair. 8. The Permit as herein set forth shall become effective when Permittee has filed in writing with the City Clerk an acceptance of the terms thereof.
