HomeMy WebLinkAboutReso 5322-1970 RESOLUTION N0. 5322 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION APPROVENG THE GRANT OF USE PERMIT RECOMMENDED BY THE PLANNING COMMISSION AS UP-146. WHEREAS, the City Council has received the report and recommendations of the Plannir.g Commission set forth in the documents designated and related to UP-146 dated April 27, 1970, all of which came on for consideration by the Council at said Council's regular meeting on the 1st day of June, 19 70, and WHEREAS, the Council did consider the same and made same part of the record in this matter and evaluated the pro- posed use and the effects thereof, together with Use Permit No. 136 granted by the Planning Commission on December 22, 1969, which is amended and modified by UP-146; NOW, THEREFORE, IT IS 0RFiERED AS FOLLOWS: 1. The Council does find, upon the report and recommen- dations of the Planning Commission as recited above, and the various documents, exhibits and related papers, all of which have been considered and made part of the record in the pro- ceedings herein, that the proposed use and modification thereof will not under the circumstances of the particular case be detrimental to the health, safety, peace, morals, comfort and general welfare of persons residing or working in the neigh- borhood and will not be detrimental or injurious to property or improvements in the neighborhood or the general welfare of the City. 2. The Council does order that: A. Use Permit No. 145, amending Use Permit No. 136, be approved on the terms and conditions made by the Plan- ning Commission in said Commission's action dated April 27, 1970, and the further conditions and qualifications des- ignated hereinafter in subparagraph B. i · B. Other or Additional Qualifications and Conditions - Lands caped Areas: (1) Constructicn and Installation: The landscape planting and facilities related thereto shall be constructed and installed in accord- ance with the plan entitled "PLOT PLAN PROPOSED CAR WASH FRONTIER CONSTRUCTION COMPANY" (UP-i4~) copies of which are mn file~in the office of the City Planner, Landscape Specialist and City Clerk· Con- struction and installation of same shall be completed before final inspection and issuance of certificate of occupancy by the Bui' ding Inspector or performance thereof secured by corporate surety bond in the prin- cipal sum of Thirty-five Hundred Dollars ($ 3,500.00 :. (2) Modificatior.: The Planning Commission, on its own motion or request of the City Planner or application by owners, may consider modification of the landscaped areas, including the facilities required therefor. The hearing shall be conducted in the manner provided for hearings for Use Permits. ( 3 ) Maintenance: a. Maintenance in accordance with approved lands cape plans' The landscaped areas, including the facilities required therefor, shall be maintained in accordance with the approved landscape plans· b. Inspectimn and report: The City Planner annually, on or before the 10th day of January, shall inspect or cause to be inspected the landscaped areas and the facilities required therefor, for the purpose · of determining whether said areas are being maintained to the standards set forth in the approved landscape plan. The City Planner, upon completion of the inspection, shall file a report with the Planning Commission and the Plan- ning Commission, upon considering said report, shall make a determination as to whether remedial work is required and should none be required, make such an order, filing a copy thereof with the City Planner and City Clerk; but if remedial work should be required, then said Commission shall set a hearing for the determination of the nature and amount of said remedial work required and the cost thereof, giving notice of said hearing to the owners, lessees, mortgagees and other parties interested in said parcel. The notice shall inform them that the lar. dscaped areas and/or facilities required therefor are deficient or are being main- tained in a manner not consistent with the approved landscape plan, specifying wherein said areas are deficient or do not so comply; and said notice shall further reqaire that the remedial work or a schedule for pe_~formance of the remedial work be filed with the City Planner within thirty (30) days after receip~ of said notice. The schedule shall set forth the performance of the remedial work within sixty (60) days, which time may be reasonably modified by the Planning Commission. If the remedial work is not so performed, or a schedule is not so filed, or after such schedule is filed the remedial work is not so performed, then the Planning Commission may, after closing the hearing, order the remedial work done and assess the cost tkereof against the owners of the property, collecting said sum by way of an action in court with jurisdiction thereof or filing said charge as a lien against the parcel and the owners thereof, as shown on the last equalized assessment roll, in accordance with the procedures set forth in this Resolution, alternate procedures herein provided or amendments hereto. (4) Terms of the Use Permit: The Planning Commission, on its own motion, or request of the City Planner, or application of the owners, lessees, mortgagees or other parties interested in the parcel, may consider a revision of the terms of this Use Permit, effecting such revision through the hearing procedure se~_ forth for Use Permits in the Zoning Ordinance of ~he City of South San Francisco. (5) Modification of Maintenance Methods: The terms of this Use Permit may be modified to provide for the use of other appropriate methods for maintaining the Landscaped areas and facilities related thereto, including procedures made applicable by amending ordinances, effecting such modification by the hearing procedure as set forth for Use Permits in the Zoning Ordinance of the City of South San Fran ci s co. (6) Endorsement of Approved Plan and Filing for Record; Endorsement~ of MOdifications and Filing for Record: The City Planner shall endorse the approved landscape plan and file or cause to be filed a copy thereof with the office of the City Clerk, Landscape Specialist and City Planner.
