A RESOLUTION DETERMINING THAT THE PUBLIC INTEREST
AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN
LAND AND DIRECTING THE FILING OF EMINENT DOMAIN
PROCEEDINGS
SOUTH MAPLE AVENUE - SOUTH CANAL STREET
RELIEF PUMP AND STORM DRAINAGE
ASSESSMENT DISTRICT
RESOLVED, by the City Ccuncil of the City of South

San Francisco, California, tkat
WHEREAS, it is the inter, tion of this Council to construct
and maintain storm drainage facilities in and on certain real
property situate in the City of South San Francisco, California;
NOW, THEREFORE, IT IS FCUND, DETERMINED and ORDERED, as
follows:
lo That the public interest and necessity require the
acquisition of a temporary ccnstruction easement in, over,
across and upon the parcel of land more particularly described
in Exhibit "A" attached hereto and by this reference made a
part hereof.
2. That said proposed acquisition is planned and located
in the manner which will be most compatible with the~'greatest
public good and the least private injury, and all of said
acquisition is situated within the City of South San Francisco,
California °
3° That John Noonan, City Attorney of this City of
South San Francisco, and the law firm of Wilson, Jones, Morton
& Lynch, be, and they are hereby directed to institute and
conduct to conclusion an action in eminent domain for the
acquisition of the said tempcrary construction easement in,
over, across and upon the parcel of land herein described, and
to take such action as is necessary therein, and said law firm
of Wilson, Jones, Morton & Lynch shall be paid a reasonable
fee therefor.
4. That an Order for I.mnediate Possession and Use be
obtained in said action, and that a warrant be issued to the
County Clerk, San Mateo County, California, in the amount
determined by the Court to be so deposited, as a condition to
.the right of ~immediate possession.
5. That this Resolutio~ shall not become effective
until July lO, 1970, and. shall not become effective at all in
the event a compromise 'settlement is made with the property
owners prior to that date.
I hereby certify that the foregoing resolution was regularly intro-
duced and adopted by the City Council of the City of South San Francisco
at a regular meeting held this 6th day of JN'ly, 1970, by the following

BEGINNING at the most northeasterly corner of that certain parcel
of land described as Parcel 1, In Volume .~ of Parcel Maps, page 2 of the
Official llecords of the County of San Marco, State of California, and
situate in the City of South San Francisco, County of San Mateo, State
of California; thence from said point of beginning proceeding along the
most northerly property line of said Parcel 1, said property line also
being the most southerly right of way line of South Canal Street, North
74° 27' West, 135.00 feet to the true point of beginning; thence from said
true point of beginning turning and leaving said northerly property line of
parcel I and continuing along the following courses: South 15° 33' West,
10. 0,0 feet; North 74° 27' West, 60.00 feet; North 15° 33' East, 10.00 feet
to the aforesaid northerly property line of Parcel 1; thence proceeding along
said northerly property line South 74° 27' East, 60.00 feet to the aforesaid
true point of beginning, The area enclose t by this temporary construction
easement is 600 square feet.
