CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION APPROVING THE SIDE LETTER TO THE
CURRENT MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF SOUTH SAN FRANCISCO AND
THE INTERNATIONAL UNION OF OPERATING
ENGINEERS, LOCAL 39, DATED JULY 1, 2011 THROUGH
JUNE 30, 2012
WHEREAS, staff recommends approval of the Side Letter to the Current Memorandum
of Understanding between the City of South San Francisco and the International Union of
Operating Engineers, Local 39 ( "Local 39 "), dated July 1, 2011 through June 30, 2012 ( "Side
Letter "); and
WHEREAS, the Side Letter was prepared by the Human Resources Department, has been
approved as to form by the City Attorney, and expresses the agreed upon terms and conditions of
shift holiday pay for Local 39.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San
Francisco that the City Council hereby approves the Side Letter to the Current Memorandum of
Understanding between the City of South San Francisco and Local 39 dated July 1, 2011 through
June 30, 2012.
I hereby certify that the foregoing Resolution was regularly introduced and adopted by
the City Council of the City of South San Francisco at a regular meeting held on the 14 day of
December, 2011 by the following vote:

Vice Mayor Pedro Gonzalez and Mayor Richard A. Garbarino

Side Letter to the Current Memorandum of Understanding
Between the
City of South San Francisco
and the
International Union of Operating Engineers, Local 39
WHEREAS, the City of South San Francisco ("City") has been informed by CaIPERS
that certain elements of compensation related to shift holiday pay that the City has been
reporting as PERS compensation are ineligible for inclusion because not specifically
described in the Memorandum of Understanding (" MOU ") between the City and International
Union of Operating Engineers Local 39; and,
WHEREAS, the City has consistently reported all elements of compensation related to
shift holiday pay to CaIPERS as reportable PERS compensation; and
WHEREAS, the parties to the MOU at all times intended that that all elements of
compensation related to shift holiday pay be reported as eligible PERS compensation;
and
WHEREAS, the parties to the MOU desire to amend their existing MOU to reflect the
intention of the parties related to shift holiday pay; and
IT IS HEREBY AGREED THAT, effective July 1, 2011, the existing MOU between the
parties shall be amended to reflect this intention, as follows:
9.7 — Shift Holiday Pay for Continuous Operations — employees assigned to continuous
operations, who by nature of their assignment are unable to observe City holidays, shall
be compensated for authorized holidays through shift holiday pay, not to exceed 8
hours, paid as straight time for the holiday and straight time for the house worked. Other
special compensation based on a percentage of base hourly rate will be calculated
based on the regular rate of pay plus shift holiday pay in those pay periods where there
is a recognized City holiday.
9.9 — Actual Holiday Staffing — In addition to the staff assigned on rotational shifts, 2
workers may be assigned to work at the Treatment Plan on 12/24 (half day) and 12/31
(half day) and the Friday following Thanksgiving. These 2 additional employees are to
be compensated at shift holiday pay computed as follows: Straight time for the holiday
and straight time for the additional hours worked. A designated City management
employee shall make the assignment. The assignment will be made, first by relying on
volunteers, but if there are no volunteers, then the assignments are made on a
rotational system established by the City. Other special compensation based on a

percentage of base hourly rate will be calculated based on the regular rate of pay plus
shift holiday pay in those pay periods where there is a recognized City holiday.
