A RESOLUTION DETERMINING THAT THE PUBLIC INTEREST AND
NECESSITY REQUIRE THE ACQL'ISITION OF CERTAIN LAND AND
DIRECTING THE FILING OF ,EMINENT DOMAIN PROCEEDINGS
TANFORAN AVENUE-SHAW RCAD STORM DRAINAGE PROJECT
ASSESSMENT DISTRICT
RESOLVED, by the City Council of the City of South
San Francisco, California, that
WHEREAS, it is the intentio.~ of this Council to construct and
maintain storm drainage fac iliti=.s in and on certain real property
situate in the City of South San Francisco, California;
NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as follows:
1. That the public interest and necessity require the acqui-
sition of an easement in, over, across and upon the parcel of land
more particularly described in E×hibit "A" hereto attached and by
this reference made a part hereof.
2. That said proposed acquisition is planned and located in
the manner which will be most compatible with the greatest public
good and the least private injury, and all of said aCquisition is
situated within the City of South San Francisco, California.
3. That John Noonan, City Attorney of this City, and the law
firm of Wilson, Jones, Morton & Lynch, be, and they are hereby
directed to institute and conduc~ to conclusion an action in eminent
domain for the acquisition of saLd easement in, over, across and
upon the parcel of land herein described, and to take such action
as is necessary therein, and~ saiC law firm of Wilson, Jones,
Morton & Lynch shall be paid a reasonable fee theref°r.
4. That an Order for Immediate Possession and Use ~be ob-
tained in said action and that a warrant be issued to the County
Clerk, San Mateo County, California, in the amount determined by
the Court to be so deposited, as a condition to the right of
immediate possession.
I hereby certify that the foregoing resolution was regularly in~ro-
duced and adopted by the City Counc:l of the City of South San Francisco
at a regular meeting held this 17th day of August, 1970, by the following

All that certain rcal prop&rty situate ir the State of California, County of
San Marco, and is described as follows:
So much of thc herein described property as lies within the lands described
in thc dccd from South San Francisco Land and Improvement Co., a corporation,
to Southern Pacific Railroad Company, a corporation, by deed recorded in Book 82
of Deeds at page 488 and by deed recorded g unc 16, 1946 from South San Francisco
Land and Improvement Company to Southern Pa(~ific Company, a corporation
(9021-G), which-is more particularly described as follows:
Beginning at a point of intcrscction of thc easterly line of Block 1 with the
southeasterly linc of Tanforan Avenue, as sa<d block and avenue arc shown on tho
-mmp of San Bruno Park 5th Addition, recorded in Book 4 at page 42 of maps in
thc Official Records of San Marco County, thence from the.point of beginning
northerly along thc northerly prolongation of said easterly linc of Block 1
North 0° 59' la" West, 16.38 feet to thc true point or beginning; thence North
0° 59' 18" West, 10.92 fcct to a point on th~ westerly right of way linc of the
Southern Pacific Railroad; thence North 65° ~,0' 42" East, 109.18 feet to a point
on the cas.t~rly right of way line of said Soukaerh Pacific Railroad; thence
proceeding along'said easterly right of way lkne, South 0059' 18" East, 10.92
feet; thence leaving said easterly right of way line, South 65020' 42" West,
109.18 feet to the aforesaid true point of beg'nning, The aforesaid description'
encompasses an area of 1091.8 square feet ri.ore or less.
