CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION AUTHORIZING GRANT OF A GRADING
PERMIT TO KAISER F07JNDATION HOSPITALS, INC.
BE IT RESOLVED by the City Council of the City of South
· San Francisco that the Director of Public Works having filed
a report of his recommendations on the application of Kaiser
FQundation Hospitals, Inc., for a grading permit to grade a
site shown on the plan entitled "Rough Site Grading Plan,
Kaiser Foundation Hospital, South San Francisco Medical Center,"
drawing number 70-697~ prepared by Lindsay Howden, A.I.A.,
Architect, 2080 Mountain Boulevard, Oakland, California, and
to import fill material therefor, the City Council hereby orders
that a grading permit shall stand issued upon the filing with
the City Clerk of an indemnity agreement as set forth in
Exhibit "A" attached hereto.

KAISER FOUNDATION HOSPITALS, INC.
SITE GRADING INDEMNITY.
KAISER FOUNDATION HOSPITALS, INC., owners of the parcel
of real property situated in the City of South San Francisco, County
of San Mateo, State of California, and more particularly described
in Exhibit "A" attached hereto and by reference incorporated herein,
having notice of the following:
1. United States Army 2orps of Engineers flood hazard
evaluation for the described parcel contained in a letter dated
June 12, 1970, to Mr. Hank ~Korley, Kirker, Chapman and Associates,
Consulting Engineers, from Department of the Army, San Francisco
District, Corps of Engineers, copy of which is on file in the
office of the City Clerk of the City of South San Francisco, and
2. That future flood plain regulations applicable to the
area in which the described parcel is located may require ele-
vations of said area above the described parcel's elevations,
nevertheless desire to obtain a permit for and to grade the
described parcel as set forth on the plans entitled "Rough
Site Grading Plan, Kaiser Foundation Hospital, South San
Francisco Medical Center, 1260 E1 Camino Real, South San
Francisco," drawing number 70-697, prepared by Lindsay Howden,
A.I.A., C-2129, 2080 Mountain Boulevard, Oakland, Catifornia~
copy of which is on file in the office of the City Clerk of

HEREBY ASSUMES the following risks of loss and make the
following waivers and indemnities which shall be binding on Kaiser
Foundation Hospitals, Inc., and its successors in interest and assigns.

1. KAISER FOUNDATION HCSPiTALS, INC., agrees to assume
any and all risks of loss caused by storm waters or floods
entering or ponding on said described parcel due to grading
to the elevation set forth on said plans.
2. KAISER FOUNDATION HDSPITALS, INC., hereby waives any
claims for damages against the City of South San Francisco, its
elective and appointive officers, agents and employees where
said damage is caused o? contributed to by storm waters or
floods entering or ponding on said parcel due to grading to'
the elevation set forth on said plans.
3. KAISER FOUNDATION HOSPITALS, INC., agrees to indemnify
and hold harmless City and its elective and appointive officers,
agents and employees from any claims or loss due to personal
injury, including death, or property damage caused or contributed
to by storm waters or floods entering or ponding on the described.
parcel as a result of grading said described parcel to the ele-
vation set forth on said plans.
IN WITNESS WHEREOF, KAISER FOUNDATION HOSPITALS, INC., by
its officers first having been duly authorized, executes this waiver
