HomeMy WebLinkAboutReso 5451-1970RESOLUTION NO. 5451 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION DECLARING COUNCIL'S INTENTION TO FORM A BUSINESS IMPROVEMENT AREA PURSUANT TO PARKING AND BUSINESS IMPROVEMENT AREA LAW OF 1965 (SECTIONS 3~000 ET SEQ., STREETS AND HIGHWAYS CODE) · The City Council of the City of South San Francisco does hereby resolve and determine, and order as follows: SECTION 1. AUTHORITY. The proceedings herein taken are taken pursuant to the authority of the Parking & Business Improvement Area Law of 1965, beginning at Section 36000 et seq. of the Streets and Highways Code. SECTION 2. INTENTION. The City Council hereby declares its intention to form a business improvement area in the City of South San Francisco in accordance with the provisions of said law. SECTION 3. NAME. The name of the proposed parking and business improvement area intended to be formed, is "THE DOWN- TOWN MERCHANTS' IMPROVEMENT AREA OF THE CITY OF SOUTH SAN FRANCISCO", hereinafter, for brevity and convenience, sometimes referred to as "AREA". SECTION 4. AREA DESCRIPTION. A description of the boundaries of said business improvement area is contained and shown upon a map which is attached hereto, marked Exhibit "A", and by this reference made a part hereof. On file with the Office of the City Clerk is a larger map of the same area, and other information concerning the extent of said "AREA". Said map is designated as "THE DSWNTOWN MERCHANTS' BUSINESS IMPROVE- MENT AREA OF THE CITY OF S0~JTH SAN FRANCISCO", and, by this reference, is made a part hereof. -1- SECTION $. PROPOSED USES. The proposed uses to which the proceeds from the additional tax revenue, realized from the additi~onal levy of a license tax as hereinafter provided, shall be put, are: 1. decoration of any public place in the AREA", 2. promotion of public events which are to take place on or in public places in the "AREA", 3. furnishing of music in any public place in the "AREA" , and, 4. the general promotion of business and retail trade activities in the "AREA". SECTION 6. ADDITIONAL LEVY OF LICENSE TAX. It is proposed that an annual additional levy of business license tax on 'businesses conducting their activities in the "AREA" which is in addition to the ordinary business license tax imposed upon such business by Ordinance No. 261 of the City of South San Francisco, as amended, shall be the sum of twice the business license fee of the businesses in the "AREA", with a maximum of $50.00, with the following exceptions: Exception 1. Ail professional and service occupations shall pay an additional fee of $25.00, paid annually in advance on the first day of January each year. Exception 2. Bank of America, South San Francisco Branch, Crocker Citizens National Bank, South San Francisco Branch, United California Bank, Linden Avenue Branch, and the First National Bank of Daly City, South San Francisco Branch, all savings and loan associations and all finance companies, shall pay a fee of $100.00, paid annually in advance on the first day of January each year. --2-- Exception 3. Theaters and pawn shops shall pay an additional fee of $50.00, paid annually in advance on the first day of January each year. SECTION 7. EXEMPTIONS: VOLUNTARY CONTRIBUTIONS. Any business, person or institution located within the said "AREA" described in the classifications hereinabove set forth, which is not subject to a business license tax or by reason of the provisions of the Constitution of the State of California or the Constitution of the United States is not to be taxed, under these proceedings, may make a voluntary contribution as set forth in the classifications hereinabove set forth. SECTION 8. BUDGET AND AGREEMENT. The City Council of the City of South San Francisco shall annually approve a budget based on a calendar year January 1st to December 31st inclusive, which shall include an estimate of income and an estimate of expenditures to be made to carry out the purposes of the "DOWN- TOWN MERCHANTS' BUSINESS IM?ROVEMENT AREA 0F THE CITY OF SOUTH SAN FRANCISCO", and by agreement shall contract with said association to carry out sa.id purposes. SECTION 9. TIME AND PLACE OF HEARING: NOTICE. Notice is hereby given that on the 21st day of December, 1970, at the hour of eight o'clock p.m., or as soon thereafter as the matter can be heard on the City Council agenda, at the City Council Chambers at City Hall, South San Francisco, California, is the time and place fixed ~or the hearing of this Resolution of Intention for the proposed formation and establishment of said "DOWNTOWN MERCHANTS' BUSINESS IMPROVEMENT AREA OF THE CITY OF SOUTH SAN FRANCISCO". Any person interested and/or objecting -3- or desiring to protest or speak in favor of the formation of the establishment of said "AREA'~ and the extent thereof, the bound- aries thereof, the proposed amount of additional levy or tax, the classification of business, or to any other proposal or matter set forth in this Resolution of Intention, may appear before the Council at said time and place specified, and be heard. SECTION 10. PUBLICATION AND MAILING OF NOTICE. The City Clerk shall cause this Resolution to be published at least once in the Enterprise-Journal, a newspaper of general circulation printed and published withir, the City of South San Francisco, the first publication shall be at least ten (10) days prior to the date of said hearing. The City Clerk shall also mail a copy of this Resolution, postage prepaid, to each business in the proposed "AREA", as described herein, which mailing shall be completed at least ten (10) days prior to the date of said hearing, all in accord- ance with Section 36022 of the Streets and Highways Code of the State of California.
