HomeMy WebLinkAboutReso 5468-1970 RESOLUTION NO. 546R CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION REGARDING ACTIONS AGAINST PROPERTY OWNERS, CON- TRACTORS AND OTHER PARTIES (FLOOD AND SILT NOVEMBER 19 70) BE .IT RESOLVED by the City Council of the City of South San Francisco that the City Attorney be and he is hereby authorized to: 1. File actions for damages suffered by the City of South San Francisco on or about November 27, 1970, against private property owners, their contractors, governmental agencies and any other parties who caused or contributed to the deposit of silt and debris ir. the storm drains of the City of South San Francisco, Colma Creek and tributaries thereto, and in the streets and other public areas of said City, all of which caused or contributed to substantial damage to public and private property in said City. 2. Seek injunctive or other appropriate relief requiring private property owners, their contractors, governmental agencies and any other parties who caused or contributed to said deposits of silt and debris to take tke necessary actions by constructing and maintaining silting basir.s, planting or other appropriate me~hods of containing the silt and debris originating on their respective properties and preventing same from being carried or deposited into the storm trains of the City of South San Francisco, Colma Creek and tributaries thereto and into the streets and other public and private property in said City. 3. Join as cross-defendants said private property owners, their contractors, governmental agencies and other parties in any actions filed against the City of South San Francisco by claimants for damages suffered by reason of said flood and silt deposits. f, ,. 4. Issue or cause issuance of any preliminary notice or claims necessary to carry out the aforegoing provisions of this resolution. I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held on the 7?h day of December , 19 70 , by the following vote: AYES, COUNCILMEN Pa$rick E.
