HomeMy WebLinkAboutReso 5484-1971 RESOLUTION NO. 5.484 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION DECLARING THE CITY'S LAND ACQUISITION POLICY APPLICABLE TO LAND TO BE ACQUIRED WITH GRANT ASSISTANCE FROM THE UNITED STATES OF AMERICA. WHEREAS, the City Council, meeting in regular session on the 18th day of January , 1971, adopted the policy outlined below as the official land acquisition policy of the City of South San Francisco applicable to the acquisition of land with grant assistance from the Department of Housing and Urban Development (HUD), and WHEREAS, Section 402 of the Housing and Urban Development Act of 1965 requires that, as a condition of eligibility for assistance under the Open Space Land Program, the City of South San Francisco must define its land acquisition policy, and WHEREAS, the City Council found that the proposed policy would provide the City witk a specific, guideline to be followed in negotiations and land acquisition using Federally assisted Open Space Land Program Funds; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of South San Francisco declares the following to be its land acquisition policy to be used in any Open Space Land Acquisition Program financially assisted by the Department of Housing and Urban Development. a. The City of South San Francisco will make every reasonable effort to acquire the property by negotiated pur- chase before instituting eminent domain proceedings (including administrative taki ~rgs and similar proceedings for the compul- sory acquisition of real property). b'. The City of South San Francisco will not require any owner to surrender possession of the property until the l. City pays, or causes to be p d, to the owner the agreed pur- chase price arrived at by ne otiation, or in any case where only the amount of payment to the owner is in dispute, not less than seventy-five nt (75%) of the appraised fair value as approved by the y or, if subsequent to HUD con- currence in the acquisition price for the property, as con- curred in by HUD. c. The City of S )uth San Francisco will not require any person lawfully occupyi: property to surrender possession without at least ninety (90 days' written notice from the City of the date on which session will be required.
