CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA
A RESOLUTION APPROVING THE ANNEXATION
OF CERTAIN UNINHABITED TERRITORY TO
THE CITY OF SOUTH SAN FRANCISCO
(ANNEXATION OF CLAY AVENUE PARK).
BE IT RESOLVED by the City Council of the City of
South San Francisco, that
WHEREAS, on the 1st day of February, 1971 said Council
did pass and adopt its Resolution No. 5487, giving notice of
the proposal to annex certain uninhabited territory to the
City of South San Francisco, said territory being therein
designated as "Clay Avenue Park Annexation" and said action
being initiated by the Council of said City as a legislative
body of the City pursuant to Section 35310 of the Government
Code of the State of California, and consent having been
given as required by the owners of said parcel and said Reso-
lution describing the boundaries of the territory so pro-
posed to be annexed to said City; and
WHEREAS, said Resolution did contain notice of the day,
hour and place when and where the said Council of said City
would hear protests made by any person owning property within
the City who does not also own property in the territory pro-
posed to be annexed, the time of said hearing being not more
than thirty days from the date of the passage of said Resolu-
tion; and
WHEREAS, on the 1st day of March, 1971 at the hour of
eight o'clock p.m. in the Council Chambers of City Hall,
South San Francisco, California, said time and place being
the day, hour and place fixed in said Resolution for hearing
protests to said annexation, the said Council of said City
did hold said hearing for the purpose of hearing and passing

upon all protests made to said proposed annexation and none
were so made; and
WHEREAS, said territory is contiguous to the City of
South San Francisco and is uninhabited territory within the
territory of the City of Daly City, which City has heretofore
consented to said territory's detachment therefrom and all
of the applicable procedural requirements of the Annexation
of Uninhabited Territory Act of 1939 (commencing at Section
35300 of the Government Code), and particularly Sections
35304 and 35310.1 thereof~ have been fully complied with~ and
WHEREAS, the San Mateo County Local Agency Formation Com-
mission did in session duly assembled on the 30th day of May,
1970, approve the proposed annexation to the City of South
San Francisco and detachment from the City of Daly City;
NOW, THEREFORE, IT IS HEREBY ORDERED AS FOLLOWS:
1. That the said Council of the City of South San
'Francisco does hereby approve the annexation of said ter-
ritory, hereinafter described, to the City of South San
Francisco and does hereby further resolve that the said ter-
ritory be, and is hereby, annexed to the City of South San
Francisco.
2. That said territory, the annexation of which to
the City of South San Francisco is hereby approved, is all
that territory situated in the County of San Marco, State
of California, more particularly described in Exhibit "A"
hereto attached and by reference made a part hereof.
3. That the City Clerk is hereby directed to prepare
under seal a certified copy of this Resolution, giving the
date of its passage, and transmit it to the Secretary of
State of the State of California.

4. That the City Clerk is hereby directed to file with
the County Recorder an affidavit of completion and attach
Certificate of the Secretary of State in accordance with
Government Code Section 34080 and file a statement or map
or plat with the State Board of Equalization in accordance
with Sections 54900 through 54903 of the Government Code of
the State of California.
