HomeMy WebLinkAboutReso 5534-1971RESOLUTION NO. 5534 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING AMENDMENT OF AGREEMENT ENTITLED, "AGREEMENT - SUBDIVISION IMPROVEMENTS AND COMMON GREENS, WESTBOROUGH-WEST PARK UNIT 8A-G." BE IT RESOLVED by the City Council of the City of South San Francisco that the provisions regarding common green , development set forth in Exhibit "A" attached hereto are approved as an amendment to the agreement between City and Developers entitled, "Agreement- Subdivision Improvements and Common Greens, Westborough-West Park Unit 3A-G." I hereby certify that the foregoing Resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a held on the 5th day of the following vote- April regular meeting 1@ 71 , by NOES, ABSENT, AYES, COUNCILMEN Patrick E. I1!:Ti EXHIBIT "A" AMENDING EXHIBIT "B" SUPPLEMENT 1 OF "AGREEMENT - SUBDIVISION IMPROVEMENTS AND COMMON GREENS, WESTBOROUGH-WEST PARK UNIT 3A-G DATED April 20, 1970 CERTIFICATES OF OCCUPANCY: A. Alternate Procedure (1). Subdividers shall not occupy or permit occupancy of the residential Units until the adjacent cpmmon green is completed and accepted by City and no certificate of , occupancy shall issue until same is-completed and accepted by City, except as provided in Alternate Procedure (2). B. Alternate Procedure (2) The City Planner and Landscape Specialist may approve issuance of occupancy permits prior to completion of common greens as set forth in Alternate (1) if subdivider has: 1) Completed the plans, specifications and construction . ,, drawings, constituting the landscape development plans as set forth in Paragraph 2 above and obtained approval of the same. '2) Filed the performance bond as required' in Paragraph above. Filed a schedule for completiOn of the common greens improvement and phases thereof substantially complying with the schedule set forth below. Constructed and installed the.phases of-improvement in accordance with the schedule. _1 - If Subdivider neglects, refuses or otherwise fails to follow the schedule for construction and installation of the common greens, except for acts of God, strikes, and similar events beyond 'control of Subdivider, then the City Planner and La'ndscape Specialist may withhold approval of occupancy permits until the imprbvement work is completed as set forth in said schedule or may require the deposit of an $ 800 additional cash se. curity for each unit for which an occupancy ; permit is issued, or may.suspend the operation of Alternat~ Procedure (2) and require Subdivider to continue .dev&lopment pursuant to Alternate Procedure (1). · . ,. - The approvals for issuance of occupancy permits shall not' be effective until same beam the written approval of the City Planner and Landscape Specialist, and a copy thereof is filed in the office of the City Clerk.
