A RESOLUTION AUTHORIZING RESCISSION OF
THE AGREEMENT BETWEEN CITY AND WM. LYON
DEVELOPMENT CO. , INC. , AND ~RELATED
MATTERS - WESTBOROUGH UNIT 4A.
BE IT RESOLVED by the City Council of the City of South
San Francisco that:
WHEREAS, the City of South San Francisco, a municipal
corporation, and Wm. Lyon Development Co., Inc., executed
an agreement the 20th day of July, 1970, providing for sub-
division improvements in an area designated Westborough Unit
4A, South San Francisco, San Mateo County, California, and
a final map entitled, "Westborough Unit 4A, South San
Francisco, San Mateo County, California," and
WHEREAS, said documents together with other documents
were placed in escrow with Title Insurance and Trust Company,
Redwood City, California, for recordation upon completion of
acquisition of said parcel by Wm. Lyon Development Co., Inc.,
and
WHEREAS, Wm. Lyon Development Co., Inc., did not complete
the acquisition of said parcel and by letter dated March 29,
1971, requests City to rescind and cancel said map and agree-
ment;
NOW, THEREFORE, IT IS ORDERED AS FOLLOWS:
1. Execution of Rescission Agreement. The execution of
an agreement rescinding the agreement between City and Wm.
Lyon Development Co., Inc., dated the 20th day of July, 1970,
providing for construction and installation of subdivision
improvements and approval of the final map, is hereby authorized
and the Mayor is authorized to execute said rescission agree-
ment on behalf of City and City Clerk attest his signature
thereto. Upon completion of the execution of said agreement

and receipt of the documents hereinafter set forth, the City
Clerk is authorized to return to Wm. Lyon Development Company
the performance bond and labor and material bond filed in
accordance with the subdivision agreement executed the 20th
day of July, 19 70.
2. Receipt and Cancellation of Documents. The City
Clerk is authorized to receive and note cancellation of ~the
following documents:
a. Agreement entitled, "Subdivision Improvements,
Westborough Unit 4A, South San Francisco,
California," made the 20th day of July, 1970,
between the City of South San Francisco, a
municipal corporation, and Wm. Lyon Development
Co. , Inc.
b. Final map entitled, "Westborough Unit No. 4A,
South San Francisco, San Mateo County, California.
3. Receipt and Retention of Documents. The City Clerk
be and he is hereby authorized to receive and retain the
following documents:
a. Declaration of Public Service Easements authorized
by Resolution 5358 passed the 20th day of July,
1970.
b. Grant of Easement - Pipeline Right-of-Way, Westborough
County Water District, authoriZed by Resolution 5357
passed the 20th day of July, 19 70.
