HomeMy WebLinkAboutReso 5554-1971 RESOLUTION NO. 5554 A RESOLUTION DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN LAND AND DIRECTING THE FILING OF EMINENT DOMAIN PROCEEDINGS STONEGATE RIDGE UNIT NO. 1 RESOLVED~ bY the City Council of the City of South San Francisco, California, that WHEREAS, it is the intention of this City Council to take additional parcels of land in connection with the improvement project known as Stonegate Ridge Unit No. 1, hereinafter more particularly designated as Parcels i-A, 2, 3, 4 and 5, NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as follows: 1. That the public interest and necessity require the acquisition, const~ction and completion of~street improvements and work auxiliary thereto in, over, across and upon Parcels i-A, 2, 3, 4 and 5, more particularly described in Exhibit "A", attach- ed hereto and by this reference made a part hereof, within said City, and the taking of: (a) The fee simple title for street purposes in and to Parcel 5, (b) Temporary slope and construction easements in, overs under, across and upon Parcels i-A, 2, 3 and 4, limited in time to the period required for the construction of the improvements afore- said, for the purpose, inter alia, of moving therein and thereon machines and equipment and of depositing thereon and removing therefrom excavated material and supplies, are necessary for said improvements. 2. That said proposed acquisitions and improvements are planned and located in the manner which Will be most compatible with the greatest public good and the least private injury, and all of said acquisitions are situate Within the City of South San Francisco, County of San Mateo, State of California. 3. That. John Noonan, City Attorney of the City of South San Francisco, and the law firm of Wilson, Jones, Morton & i. Lynch be, and they are, hereby directed to institute and con- duet to conclusion an action in eminent domain for the acquisi- tion of the said land, and to take such action as is necessary therein, and said law firm of Wilson, jones, Morton & Lynch shall be paid a reasonable fee therefor° 4o That an Order for Immediate Possession and Use be obtained in said action, and that a warrant be issued to the County Clerk, San Mateo County, California, in the amount deter- mined by the Court to be so deposited, as a condition to the right of immediate possession° I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held this 3rd day of May, 1971, by the following vote: AYES, COUNCILMEN Patrick E. Frank Mammini and Warren Steinkamp None NOES, " ABSENT, " None iio EXHIBIT "A" Ail that certain real property situate in the City of South San Francisco, County of San Mateo, State of California, and more particularly described as folrlows: Parcel 1-A A strip of land 15 feet in width lying easterly of and contiguous to the following described line: Beginning at a point on the southerly line of Lot 1, Block 3, as said Lot and Block are shown and delineated on that certain map entitled "Map of Stonegate Ridge Unit No. 1, South San Franciscoz California", recorded in Volume 64 of Maps at pages 36, 37 and 3~, San Mateo CoUnty Records, distant thereon, South 73° 15' 32" East 338.56 feet from the southwesterly corner thereof; thence leaving said southerly line, South 16° 44' 28" West 342.23 feet to a point on the northerly line of the lands of the South San Francisco School District. Parcel 2 A strip of land 15 feet in width lying westerly of and contiguous to the following described line: ~ Beginning at a point on the southerly line of Lot 1, Block 4, as said Lot and Block are shown and delineated on that certain map antitled "Map of Stonegate Ridge Unit No. 1, South San Francisco, California", recorded in Volume 64 of Maps at pages 36, 37 and 38, San Mateo County Records, distant thereon, .South 73° 15' 32" East 14.37 feet from the mo~t westerly corner thereof, thence leaving said southerly line, South 16°44' 28" West 342.23 feet to a point on the northerly line of the lands of the South San Francisco School District.
