HomeMy WebLinkAboutReso 5677-1971RESOLUTION NO o 5 6 7 7 CITY COUNCIL~ CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN LAND AND DIRECTING THE FILING OF EMINENT DOMAIN PROCEEDINGS AND APPOINTING SPECIAL COUNSEL ANTOINETTE LANE BE IT RESOLVED, by the City Council of the City of South San Francisco that: WHEREAS, the public interest and necessity require acquisition by the City of the estates and interests in the parcel of land described in Exhibit "A" attached hereto and by this reference made a part hereof, for the improvement of Antoinette Lane in the City of South San Francisco, California; NOW, THEREFORE, IT IS ORDERED THAT: lo The public interest and necessity require the acquisi- tion, construction and completion of Antoinette Lane and work auxiliary thereto in, over, across and upon the parcel of land more particularly described in said Exhibit "A" within said City of South San Francisco, County of San Mateo, State of Cali- fornia, and the taking of the fee simple title for street pur- poses in and to the parcel of land aforesaid is necessary for said imp~vemento 2o Said proposed acquisition and improvement is Planned and located in the manner which will be most compatible with the greatest public good and the least private injury, and all of said acquisition is situate within the City of South San Francisco, County of San Mateo, State of California° 3. John Noonan, City Attorney, and the law firm of Wilson, Jones, Morton & Lynch, who are attorneys for said City, be and they are hereby directed to institute and conduct to conclusion an action in eminent domain and/or to quiet title for.the acquisition of the property more particularly described in said Exhibit "A", and to take such action as is necessary therein, and said law firm of Wilson, Jones, Morton & Lynch shall be paid a reasonable fee therefor. 4. An order for Immediate Possession and Use be obtained in said action, and that a warrant be issued to the County Clerk, San Mateo County, California, in the amount determined by the Court to be so deposited, as a condition to the right of immediate possession. Frank Mammtnt and Warren Stetnkamp None ABSENT, COUNCILMEN None ATTEST: ~~' City C~e~~~ * EXHIBIT "A" All that certain real property situate in the City of South San Francisco, County of San Mateo, State of California, more particularly described as follows: BEGINNING at the intersection of the Southerly line of Chestnut Avenue, as said Southerly line is described in that certain Quit Claim Deed from California Water Service Company ~o City of South San Francisco, a municipal corporation, Dated March 29, 1949 and recorded April lB, 1949 in Book 1648 of Official Records of San Mateo County at page 61 (85325-H) with the Easterly ~ine of Mission Road; thence from said POINT OF BEGINNING South 13v 15' 50" East along the said Easterly line of Missmon Road, 24°88 feet to the point of.intersection thereof with the Northeast- erly line of the right of way of the Southern Pacific Railroad Company; thence Southeasterly along said right of way of the Southern Pacific Rail- road Company along an arc of a curve to the left, with a radius of 9549°34 feet, through a central angle of 2° 26' 18", for an arc distance of 406o37 feet, thence contmnumng along last mentmoned line South 55 59' l0 East 179o69 feet; thence at right angles North 34° 00' 50" East 59.71 feet; thence North 24° 18' 50" West 81.00 feet; thence South 65°41, 10" West B1.42 feet; thence Northwesterly along an arc of a curve to the right, wit~ a radius of 20o00 feet, through a central angle of 58° 19' 40", for an arc distance of 20°36 feet; thence North 55u 59' 10" West 77.23 feet; ---thence Northwesterly along an arc of a curve to the right, tangent to the preceeding course, with a radius of 9483°34 feet, through a central angle of 2° 26' 28" for an arc distance of 404 03 feet to a point in the said Southerly line of Chestnut Avenue; thence South 56° 47' 35" West along last mentioned line 53.24 feet to the point of beginning.
