HomeMy WebLinkAboutReso 5799-1972RESOLUTION NO. 5799 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION AUTHORIZING EXCHANGE OF PARCELS OF LAND WITH BRAEWOOD DEVELOPMENT CORPORATION, AND ACTS RE LATE D THE RE T O. BE IT RESOLVED by the City Council of the City of South San Francisco that WHEREAS, the City of South San Francisco, a municipal corporation, hereinafter designated "City" and Braewood Development Corporation, hereinafter designated "Developer" desire to exchange parcels of land situate in the City of South San Francisco, San Mateo County, California, and WHEREAS, the Planning Commission of the City of South San Francisco has reviewed the proposed exchange in relation to the final map for Braewood-Westborough Condominium Project No. 1 and recommended said exchange, and WHEREAS, the public convenience and necessity require said exchange; NOW, THEREFORE, IT IS ORDERED THAT: 1. Parcels To Be Exchanged. A. City shall convey to Developer in exchange for the parcels described in subparagraph B the parcels described in Exhibit A attached hereto subject to exceptions set forth in Title Insurance and Trust Company Report No. 40 8402 dated February 17, 19 72. Developer shall bear any and all costs of clearing objections to title. The Mayor and Mayor pro Tern are authorized on behalf of the City to execute a deed conveying said parcels. B. Developer shall convey to City the parcels described in Exhibit B attached hereto subject to the following: (1) Exceptions 3, 4, 5, 6 and 8 set forth in Title Insurance and Trust Company Report #408402 dated February 17, 19 72. (2) Easements 10 feet in width along the lines of said Lot 5 common to Lots 1, 2, 3 and 4 in said 1. Block 6 for the purposes of construction, repair and maintenance of the common area as defined on said Map (including buildings constituting a portion thereof); Grantor hereby covenanting and agreeing as owner of such easements so excepted and reserved (which covenant and agreement shall run with and be for the benefit of said Lot 5 and shall run with and be the burden of such easements so excepted and reserved and the subsequent owners thereof) to repair any damage caused by such construction, repair and maintenance to those portions of the said Lot 5 covered by such easements. (3) Easements 10 feet in width along the lines of said Lot 5 common to Lots 1, 2, 3 and 4 in said Block 6 for support and for ingress and egress in and through said Lot 5 for the benefit of the owners of the common area as defined on said Map and for the benefit of the owners of units as designated on said Map. (4) Easements 3 feet in width along those of the lines of said Lot 5 common to the Lots 1, 2, 3 and 4 in Block 6 where roof overhang easements are designated on said Map for encroachments upon said Lot 5 of doors, windows and other building protrusions extend- ing from the buildings and other structures constitu- ting a part of the common area as defined on said Map and for the benefit of the owners of the common area as defined on said Map. (5) Other easements accepted by City. (6) Delivery of Title Insurance and Trust Company CLTA standard policy of title insurance in the amount of $ 50,000.00 insuring City as vestee of said parcels subject to said exceptions. . 2. Method of Completing Exchange. The exchange may be completed in the following manner. City shall grant to Title Insurance and Trust Company Lot 37, Block 6 Westborough-West Park Unit #1, San Mateo County Records Book 61 Pages 11, 12, 13, 14, 15 and 16 (filed November 19, 1964) subject to the exceptions set forth in paragraph IA above and quitclaim to Title Insurance and Trust Company parcels A through F as shown on Exhibit A attached hereto, excepting therefrom the public utility easements "a" through "f" as shown on Exhibit A-1 attached hereto. City shall authorize said title company to convey said parcels to Developer subject to the said exceptions when the title company holds for delivery to City a grant of the parcels described in Exhibit B attached hereto subject to the exceptions, easements and delivery of title policy to City as set forth in paragraph lB above and can assure vesting City with said title. 3. Execution of Deed and Certificate of Acceptance. The May~and Mayor Pro Tern are authorized to execute the deeds necessary to so convey the City's parcels and the City Clerk is authorized to execute certificates of acceptance for parcels conveyed to City. 4. Escrow Instructions. The City Attorney is authorized to issue escrow instruc- tions and do any other acts necessary to carry out the exchange and provisions of this Resolution.
