HomeMy WebLinkAboutReso 5871-1972RESOLUTION NO. 5871 CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA A RESOLUTION ADOPTING PARK AND RECREATION COMMISSION'S POLICY RECOMMENDATION REGARD- ING SALE OF FOOD AND BEVERAGE ON CITY- OWNED OR MAINTAINED FACILITIES. WHEREAS, the Park and Recreation Commission has duly approved a "Policy on Sale of Food and Beverages at City- Owned or Maintained Outdoor Facilities" as embodied in Exhibit A attached hereto, and WHEREAS, said approved policy, recommended for incorpora- tion into the Policy Statement of the Division of Recreation and Parks as paragraph 5(B) by the Park and Recreation Com- mission, now comes before the City Council of the City of South San Francisco for final approval pursuant to City Ordinance 212, Section 8A; NOW, THEREFORE, BE IT RESOLVED by this Council of the City of South San Francisco that this Council adopts said policy and orders its incorporation as paragraph 5(B) into the Park and Recreation Division's Policy Statement regarding use of park facilities. Frank Nammini and Warren Stelnkamp NOES, " None ABSENT, " PatPf~k~E~'~ Ahem ATTEST: ~~C~~ [ ~ ' T il Iii ' il' EXHIBIT A 5(B) POLICY OF SALE OF FOOD OR BEVERAGES AT CITY-OWNED OR MAINTAINED OUTDOOR FACILITIES. ~' I. Basic Guidelines a. No food may be prepared for sale to public on City-owned or maintained outdoor facilities. b · Fully licensed mobile canteens or catering trucks may be authorized to prepare and sell food and/or beverages on City-owned or maintained outdoor facilities. Loca- tion of such vehicles will be determined by the Park and Recreation Department. C· Foods may be prepared in non-commercial kitchens if they meet all of the criteria as set forth under the California Restaurant Act. A letter of health certifi- cation for that facility from the County Health Depart- ment must be filed with the City of South San Francisco prior to issuance of a permit. d· Food and/or beverages prepared in commercial kitchens may be permitted providing said business has met all criteria set forth under the California Restaurant Act and has a proper catering license. e · Under C and D above the transportation to the facility of such food and/or beverages must be done in a safe and sanitary manner with said vehicle(s) being in a generally clean and sanitary condition· II. General Requirements a· Ail organizations wishing to offer for sale food and/or beverages must agree in writing to hold the City of South San Francisco and any and all of its employees or officials harmless and indemnify them from any and all liability for injury to person(s) or property occurring as a result of the activity sponsored by the said group. b. Ail organizations wishing to offer for sale food and/or beverages shall be liable to the City for any and all damages to property owned or maintained by the City of South San Francisco, caused by individuals connected with said organization or by any participants or spec- tators at the activity. C· Ail organizations wishing to offer for sale food and/or beverages on City-owned~ or maintained~ outdoor facilities shall provide public liability and property damage coverage insuring the City of South San Francisco and any and all employees and officials, to the limits generally required of contractors. d. Ail organizations wishing to offer for sale food and/or beverages must follow the health standards as set forth under the California Restaurant Act. 1 (Exhibit A) III. Basic Responsibilities a. The site for food and/or beverage sales will be determined by the Park and Recreation Department. b · Ail materials required for the set-up, selling, and clean-up of the area will be provided by the sponsoring organization. C· Anything related to the set-up of the facility must be of a temporary nature and nothing shall be affixed or attached to existing ground or above ground, trees, posts, etc., withoUt prior approval. d. All facets of sales shall be handled solely by members of the organization. e. Adequate supervision by adults shall be provided by the sponsoring organization. f. All costs encumbered by the Park and Recreation Depart- ment relating to food and/or beverage sales, above that which is normally available, will be entirely borne by the sponsoring organization. g. Ail publicity signs and promotional material must be undertaken by the sponsoring organization. 2 (Exhibit A)
